OR UNIT WITHIN THE DEPARTMENT MAY EXERCISE OR PERFORM,
EXCEPT THOSE VESTED BY LAW IN THE BOARD OF REVIEW OF
THE DEPARTMENT, AND THE MARYLAND AGRICULTURAL
COMMISSION. THE SECRETARY HAS GENERAL SUPERVISION,
DIRECTION, AND CONTROL OF THE PROVISIONS OF THIS
ARTICLE AND GENERALLY OF ALL MATTERS IN ANY WAY
AFFECTING OR RELATING TO THE FOSTERING, PROTECTION,
AND DEVELOPMENT OF THE AGRICULTURAL INTERESTS OF THE
STATE.
REVISOR'S NOTE: This section presently appears as
Art. 41, §435 of the Code. New language is
added throughout this and subsequent
sections identifying "positions" and units
within the Department in order to refer to
individuals included within the Department
pursuant to §2—106. Subsection (f) is
proposed for deletion since the substance
of its provisions appears in proposed
§2-102(d).
In subsection (b) language is added to
provide that the secretary may "adopt"
rules and regulations. The verbs
"prescribe" and "promulgate" are omitted
throughout this article when used in
relation to rules and regulations because
the Commission concluded that a singular
verb should be used to avoid confusion.
New language is added in subsection (b) to
indicate explicitly that the Secretary may
adopt rules and regulations to carry out
the provisions of this Article. This
provision eliminates the necessity for
including analogous provisions in each
subtitle. The provision authorizing the
Secretary to approve, disapprove, issue, or
revise the rules and regulations of every
office or agency of the Department is
proposed for deletion as unnecessary. This
power is implicit in the power to adopt
rules and regulations and in the
responsibility for adopting or reviewing
them. In subsection (b), the phrase "in
his office" is proposed for deletion
because "office" is an ambiguous concept
that could be interpreted to mean only the
office of the Secretary or the Department
in general. Consequently, the phrase "of
the Department" is added because the
