THE STATE ANY TIME DURING THE CLOSED SEASON. FIELD
TRIALS SHALL BE HELD PURSUANT TO RULES AND REGULATIONS
THE SECRETARY ADOPTS TO SAFEGUARD THE INTERESTS OF
WILDLIFE IN THE STATE.
REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 145 (a) of the Code.
The last provision is proposed for deletion
because its substance appears as proposed
section 10-703.
Subsection (b) presently appears as Article
66C, section 144 of the Code.
The only other changes made are in style.
10-703. SHOOTING GAME BIRDS AND MAMMALS OR PROTECTED
BIRDS AT FIELD TRIALS DURING CLOSED SEASON PROHIBITED;
EXCEPTION.
(A) SHOOTING GAME BIRDS AND MAMMALS AT FIELD
TRIALS DURING CLOSED SEASON PROHIBITED. - ANY CLUE OR
ASSOCIATION HOLDING A FIELD TRIAL DURING CLOSED
HUNTING SEASON MAY NOT SHOOT OR ATTEMPT TO SHOOT ANY
GAME BIRD OR MAMMAL OR PROTECTED BIRD.
(E) EXCEPTION. - GAME BIRDS BRED, RAISED, OR
PURCHASED IN CAPTIVITY MAY BE SHOT IN FLIGHT
IMMEDIATELY UPON RELEASE AT RETRIEVER TRIALS AFTER
BEING POSITIVELY IDENTIFIED.
REVISOR'S NOTE: Subsection (a) is new language
derived from Article 66C, section 145(a)
of the Code. The present prohibition
against "shooting at" game birds or mammals
is omitted and a prohibition against
attempting to shoot game is substituted
therefor. In addition, the present
reference to game protected by law is
omitted and game birds and mammals and
unprotected birds is substituted therefor.
There is no present definition of game
protected by law; game birds and mammals
are protected to the extent that there is a
season. Some birds, of course, are
protected.
Subsection (b) is new language derived from
Article 66C, section 145(a) of the Code.
