SOLE JUDGE OF WHAT CONSTITUTES "OPPOSITE SHORE" FOR
THE PURPOSES OF THIS SUBSECTION. WHERE CIRCUMSTANCES
REQUIRE AND WITH REGARD FOR THE RIGHTS OF ADJOINING
OWNERS, THE SECRETARY MAY DESIGNATE THE POINTS WITH
RESPECT TO DISTANCES FROM SHORE WHERE THE BLINDS MAY
BE PLACED. ANY RESIDENT NONOWNER OF SHORELINE MAY NOT
ERECT A BLIND SITE WITHIN 150 YARDS OF THE NEAREST
DWELLING.

(E) EXCEPTION FOR BALTIMORE COUNTY AND THE
TRIBUTARIES OF POTOMAC RIVER IN CHARLES COUNTY. -
HOWEVER, IN THE WATERS OF BALTIMORE COUNTY AND IN THE
TRIBUTARIES OF THE POTOMAC RIVER IN CHARLES COUNTY, A
PERSON MAY NOT ERECT OR MAINTAIN A STATIONARY BLIND OR
BLIND SITE AT A GREATER DISTANCE THAN 150 YARDS FROM
THE SHORELINE.

(C) EXCEPTION FOR THE CHESAPEAKE BAY IN ANNE
ARUNDEL AND CALVERT COUNTIES AND IN PROSPECT BAY. - IN
THE WATERS OF THE CHESAPEAKE BAY OPPOSITE THE
SHORELINE OF ANNE ARUNDEL AND CALVERT COUNTIES AND
PROSPECT BAY IN QUEEN ANNE'S COUNTY, A PERSON MAY NOT
ERECT OR MAINTAIN A STATIONARY BLIND OR BLIND SITE AT
A GREATER DISTANCE THAN 1,000 YARDS FROM THE SHORELINE
OF THE COUNTIES OR IN WATER OVER EIGHT FEET IN DEPTH.

(E) EXCEPTION FOR   JAMES ISLAND. - IN THE WATERS

OF DORCHESTER COUNTY     ADJACENT TO JAKES ISLAND, A

PERSON MAY NOT ERECT OR   MAINTAIN A STATIONARY BLIND OR

BLIND SITE AT A GREATER   DISTANCE THAN 1,000 YARDS FROM
THE SHORELINE.

REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 154(e) of the Code.
The reference to the exceptions in present
section 157 is proposed for deletion
because the exceptions of this section are
set forth in proposed subsection (c) of
this proposed section. This and subsequent
subsections are phrased in the negative to
maintain consistency with the majority of
sections of this title. The present
references to the distance between stakes
is proposed for deletion because this
provision appears in proposed section
10-617.

Subsection (b) is new language derived from
a similar provision in Article 66C, section
156 (b) of the Code.
