STATIONARY BLIND OR BLIND SITE MAY BE PLACED PURSUANT
TO THE PROVISIONS OF §10-617 (A).
REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 161(b) of the Code.
The reference to present section 154 is
proposed for deletion and the corresponding
proposed section is substituted therefor.
The last sentence is proposed for deletion
because its substance appears as proposed
subsection (e).
Subsection (b) presently appears as Article
66C, section 161(a) of the Code and is set
forth here to define how much shoreline a
riparian owner must own in order to erect a
stationary blind or blind site.
Subsection (c) is new language derived from
the second provision of Article 66C,
section 1 56 (b).
Subsection (d) also is new language derived
from Article 66C, section 157(b) of the
Code. The present provision requires
blinds to be at least 700 yards apart
which, by necessity, means that the blinds
have to be 350 yards from the adjoining
property.
Subsection (e) is new language derived from
Article 66c, section 161 (b).
The only other changes made are in style.
10-617. LOCATION OF BLINDS - DISTANCE BETWEEN
STATIONARY BLINDS OR BLIND SITES.
(A) DISTANCE - IN GENERAL. - SUBJECT TO THE
PROVISIONS OF THIS SECTION, A PERSON MAY NOT PLACE A
STATIONARY BLIND OR BLIND SITE LESS THAN 500 YARDS
FROM THE NEAREST LICENSED STATIONARY BLIND OR BLIND
SITE WHEN MEASURED IN A STRAIGHT LINE. ON IRREGULAR
SHORELINES IN CREEKS, COVES, BAYS, AND INDENTATIONS
WHERE IT IS IMPOSSIBLE TO PLACE THEM 500 YARDS APART,
THE SECRETARY MAY PERMIT A STATIONARY BLIND AND BLIND
SITE TO BE PLACED NOT LESS THAN 400 YARDS APART NOR
LESS THAN 150 YARDS FROM THE DIVIDING LINE. WHERE
CIRCUMSTANCES REQUIRE, THE SECRETARY MAY DESIGNATE THE
DISTANCES FROM THE DIVIDING LINE BETWEEN PROPERTIES
WITH REGARD TO THE PROPERTY RIGHTS OF ADJACENT
