10-418. SCIENTIFIC PERMITS.

(A) CERTIFICATE - IN GENERAL. - NOTWITHSTANDING
ANY OTHER PROVISION OF THIS TITLE, THE SECRETARY MAY
GRANT CERTIFICATES TO ANY PROPERLY ACCREDITED PERSON
OF KNOWN SCIENTIFIC ATTAINMENT, PERMITTING HIM TO
COLLECT WILDLIFE, NESTS, OR EGGS FOR SCIENTIFIC
PURPOSES ONLY. TO OBTAIN A CERTIFICATE THE APPLICANT
SHALL SUBMIT PROOF OF NECESSITY AND PAY A $2 FEE TO
THE DEPARTMENT. THE FEE SHALL BE DEPOSITED TO THE
CREDIT OF THE STATE [[GAME]] WILDLIFE MANAGEMENT AND
PROTECTION FUND. THE CERTIFICATE SHALL EXPIRE
DECEMBER 31 OF THE ISSUING YEAR. THE CERTIFICATION
MAY NOT BE TRANSFERRED TO ANOTHER PERSON. ON PROOF
THAT THE HOLDER OF THE CERTIFICATE HAS CAPTURED OR
KILLED ANY WILDLIFE OR TAKEN NESTS OR EGGS FOR OTHER
THAN SCIENTIFIC PURPOSES, THE CERTIFICATE SHALL BECOME
VOID.

(E) CERTIFICATES TO TRAIN FALCONS, HAWKS, OR
OWLS. - THE SECRETARY MAY GRANT CERTIFICATES TO ANY
PROPERLY ACCREDITED PERSON 18 YEARS OF AGE OR OLDER TO
TAKE ALIVE, TRAIN, AND FLY FALCONS, HAWKS, OR OWLS.
TO OBTAIN THIS CERTIFICATE AN APPLICANT SHALL PAY A $5
FEE. THE CERTIFICATE SHALL EXPIRE ON JUNE 30 OF THE
ISSUING YEAR. IT MAY NOT BE TRANSFERRED TO ANOTHER
PERSON, AND THE SECRETARY MAY REVOKE IT FOR CAUSE AT
ANY TIME. A PERSON MAY NOT POSSESS MORE THAN TWO OF
THE ENUMERATED BIRDS IN ANY COMBINATION AT ANY ONE
TIME. IN ADDITION, A PERSON MAY NOT SELL OR OFFER FOR
SALE ANY FALCONS, HAWKS, OR OWLS. THE ENUMERATED
BIRDS SHALL BE USED FOR HUNTING GAME BIRDS OR MAMMALS
ONLY DURING OPEN SEASON.

REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 141 (a) of the Code.
New language is added to indicate to the
Code user that certain acts are permitted
despite the prohibitions and restrictions
of other sections of this title. New
language derived from section 141(b) also
is added for organizational purposes.
