of this title. For this reason Article 1A,
section 30 is retained. The phrase
limiting this prohibition to aircraft in
flight is proposed for deletion in order to
prohibit any hunting from aircraft.

Subsection (k) presently appears as Article
66C, section 132(b) of the Code. The term
"law enforcement" officer is added to
indicate that any law enforcement officer
may enforce these laws.

Subsection (1) presently appears as Article
66C, section 142 of the Code. The present
section prohibits using ferrets or weasels
to hunt game birds and mammals "protected
by law". Similar language is used in
present section 143. No provision of the
present Code, however, defines or describes
"wildlife or game birds or mammals
protected by law". The department, also,
has no official definition of wildlife
protected by law and is presently
proclaiming in a haphazard fashion which
species are deemed protected by law.

Subsection (m) presently appears as Article
66C, section 143 of the Code. The word
"species" is proposed for deletion because
the definition of "wildlife" enumerates the
species. The last provision is proposed
for deletion because its substance appears
in proposed section 10-207.

Subsection (n) presently appears as Article
66C, section 132(k) of the Code. New
language is added to the first sentence to
include the acts prohibited by the second
sentence. In addition, the word
"protected" is proposed for deletion
because there is no specific definition of
protected game. Rather, the hunting of
game birds or mammals is closely regulated
and, to this extent, they are protected.
The reference to "fur—bearing animals" is
proposed for deletion because those species
are included within "game birds and
mammals". The last sentence is proposed
for deletion since its substance is
included within the first sentence.
