AND MONTGOMERY; ONE FROM SOUTHERN MARYLAND, WHICH
COMPRISES THE COUNTIES OF ANNE ARUNDEL, CALVERT,
CHARLES, PRINCE GEORGE'S, AND ST. MARY'S; AND ONE FROM
WESTERN MARYLAND, WHICH COMPRISES THE COUNTIES OF
ALLEGANY, FREDERICK, GARRETT, AND WASHINGTON. A
REGIONAL APPOINTEE SHALL BE A LICENSED WELL DRILLER
ACTIVELY ENGAGED AT THE TIME OF HIS APPOINTMENT IN THE
WELL-DRILLING BUSINESS IN THE STATE. THE GOVERNOR
SHALL APPOINT THE REMAINING THREE MEMBERS OF THE BOARD
UPON THE RECOMMENDATION OF THE SECRETARY AND WITH THE
ADVICE AND CONSENT OF THE SENATE, AS FOLLOWS: ONE
FROM THE PUBLIC AT LARGE, WHO SHALL SERVE AS THE
CHAIRMAN; ONE FROM THE DEPARTMENT; AND ONE FROM THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE. IF THERE IS
A VACANCY, [[UPON THE RECOMMENDATION]] WITH THE ADVICE
OF THE SECRETARY, THE GOVERNOR SHALL APPOINT A
SUCCESSOR TO SERVE FOR THE REMAINDER OF THE UNEXPIRED
TERM.
REVISOR'S NOTE: This subsection presently appears
as Article 96A, section 83(b) of the Code.
The reference to the "Department of Water
Resources" and "environmental health
services" is proposed for deletion and
"department" and "Department of Health and
Mental Hygiene" is substituted because of
nomenclatural changes and reorganization of
State government. The final sentence is
proposed for deletion as obsolete because
all members have been reappointed to new
terms. A substantive change in the manner
of board appointments is made. As proposed
the Governor would appoint a member upon
the Secretary's recommendation, with the
advice and consent of the Senate. This is
more logical than allowing the Secretary to
make such an appointment with approval of
the Governor. This change makes this
appointment procedure uniform throughout
this Article. The only other changes made
are in style.
(C) COMPENSATION.—THE BOARD MEMBERS WHO ARE NOT
PUBLIC OFFICIALS SHALL HAVE THE COMPENSATION PROVIDED
IN THE STATE BUDGET.
