CONDUCT IN THE COURSE OF HIS EMPLOYMENT.
(C) EACH EMPLOYER SHALL, THROUGH POSTING OF NOTICES AT
THE PLACE OR PLACES WHERE NOTICES TO EMPLOYEES ARE
NORMALLY POSTED OR OTHER APPROPRIATE MEANS, KEEP HIS
EMPLOYEES INFORMED OF THEIR PROTECTIONS AND
OBLIGATIONS UNDER THIS SUBTITLE, INCLUDING PROVISIONS OF
APPLICABLE STANDARDS.
33. RECORD KEEPING.
(A) EACH EMPLOYER SHALL MAKE, KEEP AND PRESERVE AND
MAKE AVAILABLE TO THE COMMISSIONER SUCH RECORDS
REGARDING HIS ACTIVITIES RELATING TO THIS SUBTITLE AS THE
COMMISSIONER MAY PRESCRIBE BY REGULATION AS NECESSARY
OR APPROPRIATE FOR THE ENFORCEMENT OF THIS SUBTITLE OR
FOR DEVELOPING INFORMATION REGARDING THE CAUSES AND
PREVENTION OF OCCUPATIONAL ACCIDENTS, INJURIES, AND
ILLNESSES.
(B) EACH EMPLOYER SHALL MAINTAIN, AS THE COMMISSIONER
MAY PRESCRIBE BY REGULATIONS, ACCURATE RECORDS OF, AND
MAKE PERIODIC REPORTS ON, WORK-RELATED DEATHS, INJURIES
AND ILLNESSES OTHER THAN MINOR INJURIES REQUIRING ONLY
FIRST AID TREATMENT AND WHICH DO NOT INVOLVE MEDICAL
TREATMENT, LOSS OF CONSCIOUSNESS, RESTRICTION OF WORK
OR MOTION, OR TRANSFER TO ANOTHER JOB.
(C) EMPLOYERS SHALL MAINTAIN ACCURATE RECORDS OF
EMPLOYEE EXPOSURES TO POTENTIALLY TOXIC MATERIAL OR
HARMFUL PHYSICAL AGENTS WHICH ARE REQUIRED TO BE
MONITORED OR MEASURED AS THE COMMISSIONER MAY
PRESCRIBE BY REGULATIONS. EMPLOYEES OR THEIR
REPRESENTATIVES SHALL BE GIVEN AN OPPORTUNITY TO
OBSERVE SUCH MONITORING OR MEASURING AND TO HAVE
ACCESS TO THE RECORDS THEREOF. EACH EMPLOYEE OR FORMER
EMPLOYEE SHALL HAVE ACCESS TO SUCH RECORDS AS WILL
INDICATE HIS OWN EXPOSURE TO TOXIC MATERIALS OR
HARMFUL AGENTS. EACH EMPLOYER SHALL PROMPTLY NOTIFY
ANY EMPLOYEE WHO HAS BEEN, OR IS BEING EXPOSED TO TOXIC
MATERIALS OR HARMFUL PHYSICAL AGENTS IN
CONCENTRATIONS OR LEVELS WHICH EXCEED THOSE PRESCRIBED
BY AN APPLICABLE OCCUPATIONAL SAFETY AND HEALTH
STANDARD PROMULGATED UNDER THIS SUBTITLE, AND SHALL
INFORM ANY EMPLOYEE WHO IS BEING THUS EXPOSED OF THE
CORRECTIVE ACTION BEING TAKEN.
(D) ON THE BASIS OF THE RECORDS MADE AND KEPT PURSUANT
TO THIS SECTION, EMPLOYERS SHALL FILE SUCH REPORTS WITH
THE COMMISSIONER AS HE SHALL PRESCRIBE BY REGULATION AS
NECESSARY TO CARRY OUT HIS FUNCTION UNDER THIS
SUBTITLE.
(E) NOTWITHSTANDING ANY OTHER PROVISIONS OF THIS
SECTION, EVERY EMPLOYER SUBJECT TO THE PROVISIONS OF THIS
SUBTITLE, WHO UNDER THE PROVISIONS OF ARTICLE 101 OF THIS
CODE IS REQUIRED TO SUBMIT A REPORT OF AN ACCIDENT OR
INJURY TO THE WORKMEN'S COMPENSATION COMMISSION AND
