96                                       LAWS OF MARYLAND                               Ch. 59

NECESSARY TO CARRY OUT THE INTENT OF THIS SUBTITLE.

(G) THE BOARD SHALL HOLD SUCH PUBLIC HEARINGS AS MAY
BE REQUIRED TO CARRY OUT ITS RESPONSIBILITIES UNDER THIS
SUBTITLE. ANY PUBLIC HEARING OF THE BOARD SHALL BE HELD
AT SUCH TIME AND PLACE AS THE BOARD SHALL SPECIFY.
NOTICE THEREOF SHALL BE PUBLISHED AT LEAST ONCE, NOT
LESS THAN [[TEN]] THIRTY DAYS PRIOR TO SUCH HEARING, IN
SUCH NEWSPAPER OR NEWSPAPERS OF GENERAL CIRCULATION
AS THE COMMISSIONER SHALL PRESCRIBE. NOTICE OF SUCH
PUBLIC HEARING SHALL BE FURNISHED BY THE COMMISSIONER
TO ANY INTERESTED PERSON REQUESTING SAME.

(H) THE BOARD SHALL SUBMIT TO THE COMMISSIONER, ITS
RECOMMENDATIONS AS TO SAID PROPOSED RULES,
REGULATIONS AND STANDARDS, OR MODIFICATIONS,
AMENDMENTS OR REVOCATIONS THEREOF, TOGETHER WITH A
REPORT, INDICATING THE NEED FOR THE PROPOSALS AND
SUMMARIZING THE TESTIMONY PRESENTED AT ANY PUBLIC
HEARING AND ANY OTHER INFORMATION OR TECHNICAL DATA
AVAILABLE TO THE BOARD.

(I) IF THE COMMISSIONER DETERMINES, AFTER RECEIPT FROM
THE BOARD OF ITS RECOMMENDATIONS AS TO THE PROPOSED
RULES, REGULATIONS AND STANDARDS, OR MODIFICATIONS,
AMENDMENTS OR REVOCATIONS THEREOF, TO ISSUE SUCH
PROPOSED RULES, REGULATIONS AND STANDARDS, OR
MODIFICATIONS, AMENDMENTS OR REVOCATIONS THEREOF, HE
SHALL, WITHIN FORTY-FIVE DAYS AFTER SUBMISSION BY THE
BOARD TO HIM OF ITS RECOMMENDATIONS, PUBLISH OR
OTHERWISE CIRCULATE NOTICE OF HIS INTENTION TO ADOPT
AND ISSUE SUCH PROPOSED RULES, REGULATIONS AND
STANDARDS, OR MODIFICATIONS, AMENDMENTS OR
REVOCATIONS THEREOF AND AFFORD INTERESTED PERSONS
OPPORTUNITY TO SUBMIT DATA OR VIEWS IN WRITING OR
ORALLY AT SUCH PUBLIC HEARING OR HEARINGS AS THE
COMMISSIONER MAY PRESCRIBE.

(J) THE COMMISSIONER SHALL COMPLY WITH THE PROVISIONS
OF ARTICLE 41, SECTION 9.

(K) THE COMMISSIONER SHALL COMPILE AND KEEP ON FILE IN
HIS OFFICE AS A PUBLIC RECORD A SET OF SUCH RULES,
REGULATIONS AND STANDARDS WHICH ARE IN EFFECT AND
SHALL PREPARE COPIES OF SUCH RULES, REGULATIONS AND
STANDARDS WHICH SHALL BE AVAILABLE TO EVERY INTERESTED
PERSON UPON REQUEST. THE COMMISSIONER MAY FIX A PRICE
COVERING SUCH COMPILATION WHICH SHALL COVER COST OF
PREPARATION AND MAILING.

(L) IN CASE ANY OF THE PROPOSED RULES, REGULATIONS AND
STANDARDS, OR MODIFICATIONS, AMENDMENTS OR
REVOCATIONS THEREOF SUBMITTED BY THE BOARD ARE
IDENTICAL WITH ANY RULES, REGULATIONS AND STANDARDS
PROMULGATED BY ANY OTHER DEPARTMENT, BOARD, OR PUBLIC
AGENCY OF THIS STATE, OR IDENTICAL WITH ANY NATIONAL
CONSENSUS STANDARDS AND/OR ESTABLISHED FEDERAL
STANDARDS, THE COMMISSIONER MAY ADOPT BY REFERENCE
