912                                    LAWS OF MARYLAND                             Ch. 441

on the first Monday in July, 1971, is required for the effective operation of the
District Court. Except as heretofore provided, all such clerical, administrative and
constabular employees shall be appointed by the chief judge of the District Court
upon the recommendation of the administrative judge in each district. All
constables, clerks, and clerical and administrative employees as may be necessary
to conduct the business of the court shall be in the State service.

THOSE PROBATION AGENTS OF A PEOPLE'S COURT, THE
MUNICIPAL COURT OF BALTIMORE CITY, THE MAGISTRATES
COURT, OR THE HOUSING COURT OF BALTIMORE COUNTY SHALL
BE TRANSFERRED AS OF THE FIRST MONDAY OF JULY, 1971, TO
THE MARYLAND STATE DIVISION OF PAROLE AND PROBATION
AND BECOME PART OF THE STATE CLASSIFIED SERVICE IF
FULL-TIME, AND THE UNCLASSIFIED SERVICE IF PART-TIME, WITH
ALL RIGHTS AND BENEFITS THAT ARE AFFORDED STATE
EMPLOYEES IN COMPARABLE POSITION, WITHOUT EXAMINATION
AND WITHOUT DIMINUTION IN SALARY. THESE EMPLOYEES
SHALL BE GIVEN CREDIT FOR PRIOR SERVICE WITH THE PRIOR
EMPLOYER FOR PURPOSES OF DETERMINING FUTURE ANNUAL
AND SICK LEAVE BENEFITS, AND LIKEWISE, SHALL BECOME A
MEMBER OF THE EMPLOYEES' RETIREMENT SYSTEM OF THE
STATE OF MARYLAND UNDER THE PROVISIONS OF SECTION 32A
OF ARTICLE 73B OF THE ANNOTATED CODE OF MARYLAND, AS
AMENDED, AND SHALL RETAIN CREDIT FOR PAST SERVICE IF IN
AN ACTUARIALLY-FUNDED COUNTY, CITY, OR MUNICIPAL
RETIREMENT SYSTEM. IT IS OPTIONAL ON THE PART OF A
MEMBER TO JOIN THE STATE OF MARYLAND EMPLOYEE HEALTH
CARE PROGRAM.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 442
(Senate Bill 855)

AN ACT to repeal and re-enact, with amendments, Section 40(j)(l) of Article 10
of the Annotated Code of Maryland (1968 Replacement Volume and 1972
Supplement), title "Attorneys at Law and Attorneys in Fact," subtitle "State's
Attorney," to increase the annual salary of the State's Attorney of Dorchester
County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 40(j)(1) of Article 10 of the Annotated Code of
Maryland (1968 Replacement Volume and 1972 Supplement), title "Attorneys at
Law and Attorneys in Fact," subtitle "State's Attorney," be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

40.

(j) In Dorchester County, (1) the State's Attorney's salary is [eleven thousand
dollars ($11,000.00)] FIFTEEN THOUSAND DOLLARS ($15,000.00).
