SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 420
(Senate Bill 612)

AN ACT to repeal and re-enact, with amendments, Section 726 of Article 43 of
the Annotated Code of Maryland (1971 Replacement Volume and 1972
Supplement), title "Health," subtitle "Sanitarians," and to repeal and re-enact,
with amendments. Section 206(e) of Article 41 of the said Code (1971
Replacement Volume), title "Governor - Executive and Administrative
Departments." subtitle "The Department of Health and Mental Hygiene, to
include the Board of Sanitarian Registration in the Department of Health and
Mental Hygiene, to provide the Secretary of Health and Mental Hygiene with
certain power concerning the Board, and relating generally to the Board of
Sanitarian Registration and to remove obsolete matter therefrom.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 726 of Article 43 of the Annotated Code of
Maryland (1971 Replacement Volume and 1972 Supplement), title "Health,"
subtitle "Sanitarians," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

726.

(a)  There shall be a Board of Sanitarian Registration to examine and register
qualified sanitarians. THE BOARD SHALL BE PART OF THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE AND FILE
REPORTS OF ITS ACTIVITIES WITH THE SECRETARY OF HEALTH
AND MENTAL HYGIENE AS HE PRESCRIBES.

(b)  The Board shall consist of five (5) members appointed by the Governor,
UPON THE RECOMMENDATION OF THE SECRETARY OF HEALTH
AND MENTAL HYGIENE, AND with the advice and consent of the Senate. All
Board members shall qualify for registration as a registered sanitarian under this
subtitle; provided that on or after June 30, 1970, each Board member shall be a
registered sanitarian, as provided in this subtitle.

(c)   Board members shall be appointed for a term of office as follows: One
member shall be designated for a term expiring June 30, 1970; one member shall
be appointed for a term expiring June 30, 1971; one member shall be appointed for
a term expiring June 30, 1972; one member shall be appointed for a term expiring
June 30, 1973; one member shall be appointed for a term expiring June 30, 1974.
Thereafter the term of office of each Board member shall be five (5) years.
Vacancies shall be filled by the Governor UPON THE RECOMMENDATION
OF THE SECRETARY OF HEALTH AND MENTAL HYGIENE, for
unexpired terms. The Governor may, WITH THE ADVICE OF THE
SECRETARY OF HEALTH AND MENTAL HYGIENE, remove a Board
member for misconduct in office, incompetency, neglect of duty, or other sufficient
cause after due notice and a hearing.
