AN ACT to repeal and re-enact, with amendments, Sections 128 [[and]] 129 and
130A, of Article 56 of the Annotated Code of Maryland (1972 Replacement
Volume), title "Licenses," subtitle "Horse Riding and Rental Stables," to
provide for the licensing of boarding stables, to define boarding stables,
[[except]] to exempt certain stables and farms from the provisions of the laws
relating to horse riding and rental stables, to provide for the appointment of an
inspector and correct certain language therein.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 128 [[and]] 129 and 130A, of Article 56 of the
Annotated Code of Maryland (1972 Replacement Volume), title "Licenses,"
subtitle "Horse Riding and Rental Stables," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
128.
The following words and phrases when used in this subtitle shall be construed as
follows:
(1) "Person" shall include any individual, firm, copartnership, association or
corporation.
(2) "Horse riding and rental stables" shall mean any establishment in
connection with which one or more horses [or ponies] are let for hire to be ridden
or driven, either with or without the furnishing of riding or driving instruction.
(3) "BOARDING STABLE" MEANS ANY ESTABLISHMENT WHICH
STABLES AND FEEDS MORE THAN THREE HORSES AND RECEIVES
COMPENSATION FOR THESE SERVICES. ALL REFERENCES TO
HORSE RIDING STABLES ALSO [[APPLIES]] APPLY TO BOARDING
STABLES.
[(3)] (4) "Horse" shall include both horses and ponies.
[(4)] (5) "Sales barns" shall include all establishments where horses are sold.
All references to horse riding and boarding stables shall also apply to sales barns.
129.
(A) No person shall engage in the business of operating or maintaining any
horse riding stable unless such person shall have received a license and a certificate
therefor issued by the State Board of Inspection of Horse Riding Stables.
(B) HORSE RACING STABLES AND FARMS USING HORSES FOR
AGRICULTURAL PURPOSES ARE NOT SUBJECT TO THE PROVISIONS
OF THIS SUBTITLE.
130A.
The Board shall make all necessary rules and regulations for the proper
performance of their duties and rules and regulations for the filing of applications
for licenses and the qualifications of applicants. THE BOARD, WITH THE
APPROVAL OF THE SECRETARY OF LICENSING AND REGULATIONS,
MAY APPOINT A QUALIFIED INSPECTOR TO ACT AS ITS AGENT
AND MAKE INSPECTIONS THROUGHOUT THE STATE. HE SHALL BE
PAID SUCH SALARY AS SHALL BE PROVIDED IN THE BUDGET. The
