CHAPTER 369
(Senate Bill 237)

AN ACT to repeal and re-enact, with amendments, Section 49(e) of Article 26 of
the Annotated Code of Maryland ([[1972]] 1971 Supplement), title "Courts,"
subtitle "Pensions of Judges and Their Widows," to [[revise certain aspects of
the contributing pension plan and relating generally thereto.]] permit certain
retired judges with small pensions to practice law while retired.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 49(e) of Article 26 of the Annotated Code of
Maryland ([[197211 1971 Supplement), title "Courts," subtitle "Pensions of
Judges and Their Widows," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

49.

(e) A judge who retires and accepts the pension or salary provided by this
section shall not during the period of such acceptance engage in the practice of law
[.]; BUT THIS PROHIBITION DOES NOT APPLY TO ANY JUDGE WHO
HAS ATTAINED THE AGE OF SEVENTY (70) AND RECEIVES LESS
THAN $3,500 PER ANNUM IN PENSION OR SALARY AS PROVIDED BY
THIS SECTION, AND WHO HAS NOT VOLUNTARILY RETIRED. A judge
who has been receiving the benefits provided by this section and who decides to
engage in the practice of law may notify the Governor and Comptroller of such
fact, and on the indicated date of his engaging in the practice of law his benefits
under this section shall cease and no longer be paid; and such a judge shall never
again be paid such benefits. In the event that a retired judge who has never been
paid benefits under this section and who has been engaged in the practice of law
should thereafter relinquish such practice and notify the Governor and Comptroller
of the State of such fact, then, from and after the date of such notification the
judge shall be entitled to all the benefits provided by this section.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 370
(Senate Bill 238)

AN ACT to repeal and re-enact, with amendments, Section 22A of Article 73B of
the Annotated Code of Maryland ([[1970 Replacement Volume and]] 1972
Supplement), title "Pensions," subtitle "Employees of Municipal Corporations,"
to provide for membership by masters in chancery of the Circuit Court of
Baltimore City, either in a local pension system or the State Employees'
Retirement System, to require approval of the local legislative body and
