(2) To any person who conscientiously believes that the seventh day of the week
ought to be observed as the Sabbath and who actually refrains from secular
business and labor on that day, and whose business establishment or establishments
or employer's business establishment or establishments (whether a sole
proprietorship, partnership or corporation) are actually closed on that day; or
(3) To any person who conscientiously believes that the Sabbath begins at
sundown on Friday night and ends at sundown on Saturday night and who actually
refrains from secular business and labor during such period, and whose business
establishment or establishments or employer's business establishment or
establishments (whether a sole proprietorship, partnership or corporation) are
actually closed during such period.

Nothing contained in § 492 of this article, however, shall be construed as
prohibiting, penalizing or making unlawful the playing of basketball or the
operation of any bowling alley, tenpin alley or duckpin alley or swimming pool,
between the hours of 1 p.m and 6 p.m on Sunday, with or without a charge or fee,
or the playing, within the corporate limits of the City of Hagerstown, on the first
day of the week, commonly called Sunday, of games of baseball by any person or
persons who engage therein as an occupation, pursuit or business, whether the
same be played for recreation or admission to said games be charged; provided,
however, that it shall be unlawful for any person or persons who engage therein as
an occupation, pursuit or business, to play said games of baseball on the first day
of the week, commonly called Sunday, within the corporate limits of the City of
Hagerstown, except between the hours of 2 p.m and 5 p.m, or to play said games
of baseball within one hundred (100) yards of any existing permanent church
edifice where religious services are being held. ]

Nothing contained in said § 492 shall be construed as prohibiting, penalizing or
making unlawful the officiating at or assisting in the conduct of the playing of
games of baseball within the corporate limits of the City of Hagerstown on the
first day of the week, commonly called Sunday, of an umpire, manager,
groundkeeper, gatekeeper, ticket seller, guard or any other attendant, although
such person or persons so officiating at said games of baseball or assisting in the
conduct thereof, are engaged therein as an occupation, pursuit or business,
provided, however, that it shall be unlawful for any person or persons, who engage
therein as an occupation, pursuit or business, to officiate at or assist in the conduct
of the playing of games of baseball as an umpire, manager, groundkeeper,
gatekeeper, ticket seller, guard or attendant, within the corporate limits of the City
of Hagerstown, on the first day of the week, commonly called Sunday, except
when such games are played between the hours of two p.m. and five p.m. and are
not played within one hundred (100) yards of any existing permanent church
edifice where religious services are being held.]

Any person violating any of the provisions of §§ 497 and 498 shall be deemed
guilty of a misdemeanor and for each and every offense shall be subject to a fine
of not more than one hundred dollars ($100.00).]

(J) NOTWITHSTANDING ANYTHING TO THE CONTRARY, THE
PROVISIONS OF THIS SECTION SHALL NOT APPLY TO
WASHINGTON COUNTY.
