SECTION 2. AND BE IT FURTHER ENACTED, That this Act is hereby
declared to be an emergency measure and necessary for the immediate preservation
of the public health and safety and having been passed by a yea and nay vote
supported by three-fifths of all the members elected to each of the two Houses of
the General Assembly, the same shall take effect from the date of its passage.

AN ACT to repeal and re-enact, with amendments, Section 492 of Article 27 of
the Annotated Code of Maryland (1971 Replacement Volume and 1972
Supplement), title "Crimes and Punishments,'" subtitle "Crimes and
Punishments," subheading "Sabbath Breaking," and to repeal Sections 497,
498, and 499 of the same Article, title and subtitle, and to add new Section
521(j) to the same Article, title and subtitle to follow immediately after Section
521(i) thereof, and to repeal and re-enact, with amendments, Section 522 of the
same Article, title and subtitle, [ [to except Washington County from Sabbath
Breaking provisions, ]] and to add new Section 534O to the same Article, title
and subtitle, to follow immediately after Section 534N thereof, relating
generally to the conduct of certain business activities on Sundays in Washington
County, and correcting an error therein.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 492 of Article 27 of the Annotated Code of
Maryland (1971 Replacement Volume and 1972 Supplement), title "Crimes and
Punishments," subtitle "Crimes and Punishments," subheading "Sabbath
Breaking," be and it is hereby repealed and re-enacted, with amendments, and that
Sections 497, 498 and 499 of the same Article, title and subtitle, be and they are
hereby repealed, and that Section 521(j) be and it is hereby added to the same
Article, title and subtitle, to follow immediately after Section 521(i) thereof, and
that Section 522 of the same Article, title and subtitle be and it is hereby repealed
and re-enacted, with amendments, and that new Section 5340 of the same Article-
title and subtitle be and it is hereby added to follow immediately after Section
534N thereof, and all to read as follows:
492.
No person whatsoever shall work or do any bodily labor on the Lord's day,
commonly called Sunday; and no person having children or servants shall
command, or wittingly or willingly suffer any of them to do any manner of work
or labor on the Lord's day (works of necessity and charity always excepted), nor
shall suffer or permit any children or servants to profane the Lord's day by
gaming, fishing, fowling, hunting or unlawful pastime or recreation; and every
person transgressing this section and being hereof convicted shall forfeit five
dollars, which, if the fine is imposed by a circuit court of any county or the
Criminal Court of Baltimore, shall be applied to the use of the county or city as
the case may be. Notwithstanding anything to the contrary, the provisions of this
section shall not apply:
(1) To Baltimore County, Prince George's County, WASHINGTON
COUNTY, or Montgomery County, or
