A person who violates the provisions of this subheading or of rules or
regulations made by the Commission of Forests and Parks, or by the district
forestry board, with the approval of the Commission of Forests and Parks under
the authority of this subheading, shall be deemed to have committed a
misdemeanor and shall be fined not less than $10 nor more than $500, or
imprisoned for not more than six months. The fines shall be collected pursuant to
the provisions of Article 26, § 155; however, if the fine is imposed by the circuit
court of any county or the Criminal Court of Baltimore, as the case may be, the
fine when collected shall be appropriated for the use of the Commission of Forests
and Parks and applied to the administration of this law.

In case such herds are not attended in the manner set forth in § 467, the owner
or owners' of said herds shall, upon conviction thereof be guilty of a misdemeanor
and subject to a fine of not less than $5.00 and not more than $25.00 for each and
every offense by the court in the county in which said offense was committed. Any
fine imposed under this section shall be collected pursuant to the provisions of
Article 26, § 155; however; if the fine is imposed by the circuit court of any county
or the Criminal Court of Baltimore, as the case may be, the fine when collected
shall be paid to the Commissioner of Motor Vehicles of the State of Maryland, for
the use of the improved highways of the State.

(b) The term "distribute" means to import, manufacture, produce, compound,
mix, blend, barter, sell, offer for sale, consign, furnish, provide or otherwise supply
commercial fertilizer or soil conditioner as part of a commercial enterprise. The
term "distributor" means any person who distributes. The term "distributee"
means any person to whom commercial fertilizer or soil conditioner is distributed.

(b) No lease shall be granted for any of the following submerged areas of this
State, nor shall any person acquire by lease, assignment, appropriation, or
otherwise any of [those] THESE areas: any area beneath any creek, cove, bay, or
inlet less than one hundred yards wide at its mouth at mean low water; any natural
oyster bar or natural clam bar as defined in this subtitle; any area within fifty
yards of any natural oyster bar or natural clam bar in any county; any area within
two hundred yards of any natural oyster bar or natural clam bar in the
Chesapeake Bay; any crab bed or clam bed as defined by the charts or amended
charts of the Oyster Survey of 1906 to 1912 on file in the offices of the
Department of Tidewater Fisheries. Any lease granted in violation of the
provisions of this subsection shall be null and void and the land described in such
lease shall revert to the State as though no lease had been made. For the purposes
of this section, "natural clam bar" means any area of submerged tidal bottom not
classified as a natural oyster bar which has a population of clams of any species
judged by the Secretary of Natural Resources to be of significant commercial
value.

All moneys received by the Comptroller of the Treasury, under the provisions of
this subtitle, from license fees, taxes, fines, penalties, and forfeitures, imposed by
any circuit court or the Criminal Court of Baltimore City, and all royalties paid to
the State for oyster shells and clam shells removed from bottoms beneath the tidal
waters of Maryland or any other source, shall be credited by said Comptroller to
