CHAPTER 48
(House Bill 771)

AN ACT to repeal and re-enact, with amendments, Section 37(e) of Article 87 of
the Annotated Code of Maryland (1969 Replacement Volume), title "Sheriffs,"
subtitle "Compensation and Duties," and to add new Section 26E to Article 36
of the Annotated Code of Maryland (1971 Replacement Volume and 1972
Supplement), title "Fees of Officers," subtitle "Sheriffs," to follow immediately
after Section 26D thereof, to increase the annual salary of the Sheriff of
Caroline County to twelve thousand dollars ($12,000.00) and to increase the fee
for serving a paper which is not an act of execution or attachment to five
dollars ($5.00) and to increase the fee for any action or service which includes
an act of execution or attachment to ten dollars ($10.00).

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 37(e) of Article 87 of the Annotated Code of
Maryland (1969 Replacement Volume), title "Sheriffs," subtitle "Compensation
and Duties," be and it is hereby repealed and re-enacted, with amendments, and
that new Section 26E be and it is hereby added to Article 36 of the Annotated
Code of Maryland (1971 Replacement Volume and 1972 Supplement), title "Fees
of Officers," subtitle "Sheriffs," to follow immediately after Section 26D thereof,
and to read as follows:

Article 87

37.

(e) The Sheriff of Caroline County shall receive an annual salary of [six
thousand five hundred dollars ($6,500)] TWELVE THOUSAND DOLLARS
($12,000) and shall be allowed his necessary expenses for mileage in connection
with his official duties and for boarding and keeping prisoners at the county jail.
He shall appoint a deputy, who shall receive an annual salary of not less than two
thousand eight hundred dollars ($2,800), and a matron-cook for the county jail,
who shall receive an annual salary of not less than two thousand five hundred
dollars ($2,500). He may appoint such additional deputies as may be necessary,
with the approval of the County Commissioners as to number and compensation.

Article 36
26E.

THE SHERIFF OF CAROLINE COUNTY MAY CHARGE AND
COLLECT THESE FEES: (1) FOR ANY ACTION OR SERVICE WHICH
INVOLVES ONLY THE SERVING OF A PAPER AND IS NOT AN ACT
OF EXECUTION OR ATTACHMENT, A FEE OF $5.00 (2) FOR ANY
ACTION OR SERVICE WHICH INCLUDES AN ACT OF EXECUTION OR
ATTACHMENT, INVOLVING A SEIZURE OR A TAKING INTO
CUSTODY OF ANY PROPERTY, REAL OR PERSONAL, OR OF ANY
PERSON, A FEE OF $10.00. IF THE SHERIFF INCURS ANY ACTUAL
EXPENSES FOR THE PURPOSE OF CONSERVING AND PROTECTING
PROPERTY SEIZED, HE SHALL BE ENTITLED TO REIMBURSEMENT
FOR SUCH EXPENDITURES.

SECTION 2. AND BE IT FURTHER ENACTED, That the increase in
compensation for the Sheriff of Caroline County provided by this Act shall
commence with the beginning of the next term of office following the effective date
