the General Assembly, the same shall take effect from the date of its passage.

AN ACT to re-number present Section 545(b) and (c) of Article 43 of the
Annotated Code of Maryland (1971 Replacement Volume), title "Health,"
subtitle "Cosmetologists," to be new Section 545 (d) and (e) and to add new
Section 545 (b) and (c) to Article 43 of the Annotated Code of Maryland (1971
Replacement Volume and 1972 Supplement), same title and subtitle to follow
immediately after Section 545 (a) thereof, [[[]] to allow for representation by
counsel at hearings called by the Board of Cosmetologists and [[]]]] to allow
the Board to impose a fine [[in lieu of suspending or revoking a license]] and
to re-number subsections therein.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That present Section 545 (b) and (c) of Article 43 of the
Annotated Code of Maryland (1971 Replacement Volume), title "Health," subtitle
"Cosmetologists," be and they are hereby re-numbered to be new Section 545 (d)
and (e); and that new Section 545 (b) and (c) be and they are hereby added to
Article 43 of the Annotated Code of Maryland (1971 Replacement Volume and
1972 Supplement), same title and subtitle to follow immediately after Section 545
(a) thereof, and to read as follows:

THE BOARD MAY BE REPRESENTED BY COUNSEL, [[]]]]
[[(C) IN LIEU OF A SUSPENSION OR REVOCATION]] [[(B)]] (C) IF
THE BOARD HAS DETERMINED THAT A LICENSEE HAS
CONDUCTED ITSELF IN SUCH A MANNER AS TO PERMIT
SUSPENSION OF A LICENSE, THE BOARD MAY [[ACCEPT A FINED
IMPOSE A PENALTY OF NOT [[LESS THAN $25.00 NOR]] MORE
THAN $500.00 FROM THE LICENSEE WHOSE LICENSE IS SUBJECT TO
SUSPENSION OR REVOCATION UNDER THE PROVISIONS OF THIS
SUBTITLE.
[(b)] [[(D)]] [[(C)]] (D) The Board shall adopt a seal for its use, which shall
appear on all certificates.
[(c)] [[(E)]] [[(D)]] (E) All funds received as a result of the issuance or
renewal of certificates of registration shall be paid over to the State Treasurer, and
shall become general funds of the State. Such moneys shall thereafter be disbursed
by the Comptroller only pursuant to an appropriation made in accordance with §§
32 and 52 of Article 3 of the Constitution or pursuant to the provisions of §§ 1
through 15, inclusive, of Article 15A of this Code, title "Budget and Procurement,"
as amended from time to time.
