ACT to amend Chapter 100, title "Sewage Disposal,"
of the Montgomery County Code 1965, as amended,
by repealing and re—enacting with amendments,
Section 100—4 thereof to permit the
reconstruction and repair of septic tanks and
tile systems pertaining to dwellings existing on
September 1, 1971, located within a fifty year
flood plain which abuts a creek or other recess,
etc., in the shore of a river.
SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
FOR MONTGOMERY COUNTY, MARYLAND That subsections (c)
and (d) of Section 100-4, title "General Requirements
for Water-Carried Systems," of Chapter 100 of the
Montgomery County Code 1965, as amended, is hereby
amended by adding a new subsection (6) to subsection
(c) and a new subsection (8) to subsection (d) to read
as follows:

Systems.
General Requirements for Water-Carried
(c) Septic tanks. Septic tanks shall comply
with the following requirements:

(6) NOTWITHSTANDING ANY OF THE PROVISIONS
HEREOF, SEPTIC TANKS EXISTING ON SEPTEMBER 1, 1971,
AND LOCATED WITHIN ANY FIFTY YEAR FLOOD PLAIN WHICH
ABUTS A CREEK OR OTHER RECESS, COVE, BAY OR INLET IN
THE SHORE OF A GIVER WHICH ARE DAMAGED OR DESTROYED AS
A RESULT OF A FLOOD MAY BE REPAIRED OP RECONSTRUCTED
OF OTHERWISE PLACED IN USABLE CONDITION.
(d) Subsurface tile systems. Subsurface tile
systems, where used, shall comply with the following
requirements:
