AN ACT to amend Article III, Chapter 77, title
"Anti—Discrimination," of the Montgomery County
Code 1965, as amended, by adding a new Section
77-14A, title "Requirements," and by repealing
and re—enacting, with amendments, Section 77—15,
subsections (e) and (h) of Section 77—17; and by
adding a new subsection (c) to Section 77-19, and
by repealing and re—enacting, with amendments,
Section 77—20 thereof to provide for posting and
record keeping requirements of real estate
brokers; to allow complaints to be filed by ones
other than those discriminated against; to
provide for testing by the staff of the
Commission or volunteers authorized by the
Commission; to permit the complainant to appear
before the Commission Panel before dismissal of
his complaint; to eliminate bond requirements; to
require that findings of reasonable grounds of
law violation by a person licensed by the Real
Estate Commission of Maryland and the final
disposition of such complaints be sent to the
Real Estate Commission of Maryland; to provide
penalties of fine for violations of a consent
agreement or summons; and to allow one who has
been discriminated against to sue for damages in
a civil action not sooner than forty-five (45)
days after the complaint has been filed with the
Commission.
SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
FOR MONTGOMERY COUNTY, MARYLAND, That Section 77-14A,
title "Requirements," is hereby added to the
Montgomery County Code 1965 to follow immediately
after Section 77—14 and to read as follows:
77-14A. REQUIREMENTS.
(A) EVERY REAL ESTATE BROKER SHALL POST IN A
CONSPICUOUS LOCATION IN THAT PORTION OF HIS PLACE OF
BUSINESS NORMALLY USED BY HIM FOR NEGOTIATING THE
