COUNTY LOCAL LAWS

SECTION 14. Section 81(e) , title "Applicability
of Amendments" is hereby added, as follows:

(E) APPLICABILITY OF AMENDMENTS. UNLESS
SPECIFICALLY PROVIDED HEREIN NO CHANGES IN THE
RETIREMENT SYSTEM LAW OR IMPROVEMENTS OF RETIREMENT
BENEFITS SHALL BE APPLICABLE TO FORMER MEMBERS,
RETIRED MEMBERS OR VESTED MEMBERS.

NOTWITHSTANDING ANY PROVISION OF THIS RETIREMENT
LAW, ANY BENEFIT ONCE GRANTED TO A MEMBER WHO HAS
RETIREE OR VESTED PAY NOT BE REDUCED BELOW THE BENEFIT
TO WHICH HE WAS ENTITLED AT THE TIME OF RETIREMENT OR
VESTING.

SECTION 15. Section 86(dd), title "Spouses,"
86(gg), title "Actual County Service," 86(hh), title
"Retired Member," and 86(s), title "Average Final
Earnings," are hereby amended, as follows:

(dd) Spouses shall mean only the husband and wife
of a member living as husband or wife with the member
at the time of the member's death. A divorced spouse,
including a mensa et thoro shall not be included in
the term spouse for the purposes of receiving any
benefits under this law. In unusual circumstances the
County Personnel Board may consider reasonable
exceptions to this rule.

(gg) "Actual County Service" includes only that
credited County service during which a member was
actively employed, or on a period of authorized
military leave-without-pay. It. does not include any
sick leave accrual credited for retirement purposes,
any periods of authorized leave-without-pay, any
periods of time that an employee is on authorized
leave-without-pay which may be purchased for
retirement on credits, a period of military service
purchased for retirement credits, or any other
non—active employment periods as determined by the
County Personnel Board.

(hh) "Retired Member" includes any member who has
retired and who is receiving retirement benefits. It
does not include any active member or a vested member.

(s) "Average Final Earnings" shall mean the
regular earnings of a member for the last twelve (12)
months of service as a member immediately preceding
