MONTGOMERY COUNTY

is covered under another retirement system provided
for in State law to which he cannot transfer the
retirement credits he has accrued as a member of the
Employees' Retirement System of Montgomery County, may
vest immediately irrespective of his County service.

Notwithstanding other provisions of this law, any
such member leaving the County service for the purpose
noted hereinabove on or after August 15, 1965, may
have his accumulated sick leave credited for vesting
purposes on the same basis as provided in Section
94-65(n) of this law.

SECTION 11. Sections 70 (a), title "Beneficiary
Death Benefits of an active member whose death is not
service connected," 70(b), title "Spouse's and
children's benefits of a member whose death is service
connected," and 70(e), title "Spouse's Benefits," are
hereby amended as follows:

(a) Beneficiary Death benefits of an active
member whose death is not service connected. Upon the
death of a member in the service of the County on or
after November 1, 1971 under conditions other than
those described in paragraph (b) "Spouse's and
children's benefits of a member whose death is
service—connected," of Section 94—70, his beneficiary
will receive a death benefit payment. The payment
will equal:

(1)  his member contributions, with credited
interest; plus

(2)   if the member was a member of the
Employees' Retirement System of the State of Maryland
as of August 15, 1965, and became a member of the
Employees' Retirement System of Montgomery County on
or before December 31, 1966, or such later agency
entrance date approved by the County Personnel Board,
without a break in service, and who is not on leave
without pay except for authorized leave without pay
for illness, fifty percent (50%) of his average final
earnings. (See Section 94-69(f), "leave of absence.")

(b) Spouse's and children's benefits of a member
whose death is service connected. If a member dies
while in the service of the County on or after
November 1, 1971, and proof satisfactory to the County
Personnel Board is received that his death was the
