COUNTY LOCAL LAWS

article, effective November 1, 1971, should a
participating elective or appointive member
(Retirement Group A member) as defined in Section
94-61(f) and (g) not be reappointed or elected after
completion of ten years of credited service, he may
elect, regardless of age in lieu of the return of his
member contributions with credited interest, to
receive a pension commencing immediately, or if he
becomes a member on or after November 1, 1971,
commencing at age 60, equal to:

(1)  two percent {2%) of his final earnings,
multiplied by

(2)   his years of credited service, up to a
maximum of thirty-six years of credited service, but
not less than $300.00 monthly.

There shall be included in the County's budget
any additional amount required to pay such pension.

(f)  Leave of Absence. A leave of absence duly
authorized by the County Personnel Board for
retirement system membership purposes which does not
exceed three years will not be considered termination
of service if the member returns to the service of the
County at the end of such leave of absence and he does
not withdraw his retirement contributions during the
interim. Except as may otherwise be specifically
provided in this article, any period of leave of
absence shall not be counted as credited service.
Whenever a member who qualifies to receive the death
benefit provided in Section 94-70 (a)(2), title "Single
lump sum death benefit," is granted an authorized
leave of absence except for authorized leave without
pay for illness, and dies during such leave of
absence, his beneficiary shall be entitled to receive
such death benefit only if both the member and the
County contributions were being paid into the County's
retirement fund on a current basis while the member
was on leave of absence.

(g)   Transfer to another position or office not
covered under the Employees' Retirement System of
Montgomery County. Notwithstanding other provisions
of this law, any member of the Employees' Retirement
System of Montgomery County who is transferred,
promoted, appointed or elected on or after August 15,
1965, to another position or office and whose salary
an incumbent thereof is paid for by the County but who
