COUNTY LOCAL LAWS

(j) Administrative retirement on or after
elective early retirement date. The County Executive
or the Chief Administrative Officer only may retire
immediately and without cause any County employee who
has attained his elective early retirement date and
who is under his supervision if in his judgment such
action is justified and demonstratively in the best
interest of the County service and his administration.
In such retirement the early retirement reduction
factors shall not apply and the County employee member
shall receive a pension, commencing immediately equal
to fifty percent (SOT?) of his final earnings or equal
to two percent (21) of his final earnings multiplied
by his actual years of credited service whichever is
greater. In addition any such member who is retired
on or after November 1, 1971 under the provisions of
Section 94—62 (j) "Administrative retirement on or
after elective early retirement data" shall be
credited with one percent (1%) service recognition
factor for each five years of actual County service up
to thirty (30) years, that shall be added to the above
computations and also the amount of sick leave
creditable for retirement purposes shall be added
thereto. The decision of the County Executive or the
Chief Administrative Officer may be appealed by the
County employee member to the County Personnel Board
whose decision shall be final. Appeal procedures
provided in the Personnel Regulations shall be
followed in making and handling such appeals. This
type of retirement shall not become effective, in the
event the employee does not appeal, without action of
the County Personnel Board whose decision shall be
final. Such retirement shall be considered as a
separation from the County service in good standing
and without prejudice. There shall be included in the
County budget any additional amount to pay such
pension.

SECTION 4. Section 63 (a) , title "Percent of
member contributions" is hereby amended to read as
follows:

(a) Percent of member contributions. The percent
of member contributions shall be determined in
accordance with the following:

(1) Each member entering the retirement
system on or after August 15, 1965 shall have a member
