record and his medical record, including the opinion
of the Medical Examiner, and all other pertinent
information must be transmitted to the County
Personnel Board. The decision of the County Executive
or the Chief Administrative Officer or the
administrative head of a participating agency may be
appealed by the member to the County Personnel Board
whose decision shall be final. Appeal procedures
provided in the Personnel Regulations shall be
followed in making and handling such appeals. This
type of retirement shall not become effective in the
event the employee does not appeal, without the action
of the County Personnel Board whose decision shall be
final. (See Section 94-67(h), Administrative
disability retirement.)
(i) Administrative retirement on or after normal
retirement date. The County Executive or Chief
Administrative Officer only may retire immediately and
without cause any County employee member only under
his supervision who has reached his normal retirement
date, if in his judgment such action is justified and
demonstratively in the best interest of the County
service and his administration. The decision of the
County Executive or the Chief Administrative Officer
may be appealed by the County employee member to the
County Personnel Board whose decision shall be final.
Appeal procedures provided in the Personnel
Regulations shall be followed in making and handling
such appeals. This type of retirement shall not
become effective in the event the employee does not
appeal, without action of the County Personnel Board
whose decision shall be final. Any such retirement
effective May 1, 1970 or thereafter shall be
considered a separation from the County service in
good standing and without prejudice. Any such retired
member who retires May 1, 1970 or thereafter shall
receive a pension commencing immediately and the
provisions of Section 94—69(c) "Discontinued Service
Pension of Employee Members" shall be applicable in
determining the amount of such pension. In addition,
any such member who is retired on or after November 1,
1971 under the provisions of Section 94—62(i)
"Administrative Retirement on or After Normal
Retirement Date" shall be credited with one percent
(1%) service recognition factor for each five years of
actual county service up to thirty (30) years, that
shall be added to the above computations and also the
amount of sick leave creditable for retirement
purposes shall be added thereto.
