that a member eligible for early or normal
retirement dies while on active service with the
County; to provide for judicial appeal from the
decision of the Personnel Board; to provide
clarification of the eligibility of members with
regard to benefit improvements; to clarify the
definition of the term "spouses"; and to define
the terras "Actual County Service", and "Retired
Member".

SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
FOR MONTGOMERY COUNTY., MARYLAND, That Sections 60(b),
title "Coverage" and 60 (c), title "Coverage of
Part葉ime Employees" are hereby amended to read as
follows:

(b)    Coverage. The primary purpose of the
retirement system is to provide a pension and other
benefits under the provisions of this article for
qualified full-time and part-time paid employees of
the County, of other agencies supported or financed
wholly or in part by taxes levied by the County
Council, or of any agency supported by bond issues
underwritten by the County or of political
subdivisions of Montgomery County. Membership in this
retirement system of other than County employees may
be accomplished by written request of the agency which
wishes its employees to be covered and approval by the
County Personnel Board. No liability shall accrue to
Montgomery County by the inclusion of other than
employees of Montgomery County under this retirement
system. Each participating agency shall be fully
responsible for the cost of coverage of its employees
and any necessary administrative costs which the
County may charge for administrative services
provided.

(c)  Coverage of part葉ime employees. When deemed
practicable and in the best interest of the County
service, the County Personnel Board may include as a
member of the retirement system each part葉ime paid
employee of the County, or a participating agency, who
meets the requirements specified hereinafter. The
effective date of coverage of less than full葉ime
employees and the types of less than full葉ime
employees to be covered shall be determined by the
County Personnel Board if not specifically provided
