the base refuse charge for any particular type of
refuse that has a cost of disposal greater than the
base refuse charge or for which any ether jurisdiction
in the Metropolitan—Washington, D.C. area is charging
more than the base charge of the County. The Council
may, by resolution, change such base rate for any
succeeding fiscal year prior to July 1 of such year.

SECTION 2. The Council hereby declares that an
emergency exists and that this legislation is
necessary for the immediate protection of public
health and safety. Therefore, this Act shall take
effect on the date on which it becomes law.

AN ACT to add a new subsection (d) to Section 87-24,
title "Billing and Collection of Refuse Disposal
Charge," Chapter 87, title "Garbage and Refuse,"
Montgomery County Code 1965, as amended, to
provide an annual credit towards refuse disposal
charges or refund of refuse disposal charges of
any city, town, village, special taxing area,
State or federal agency which provides street
cleaning and repair service for its streets and
roads open to and used by the general public.

SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
FOR MONTGOMERY COUNTY, MARYLAND, That a new subsection
(d) is hereby added to Section 87-24, title, "Billing
and Collection of Refuse Disposal Charge," Chapter 87,
title "Garbage and Refuse," of the Montgomery County
Code of 1965, as amended, to read as follows:

87-24.

(D) CREDIT TOWARDS OR REFUND OF REFUSE DISPOSAL
CHARGES FOR STREET CLEANING.

(1) ANY CITY, TOWN, VILLAGE OR SPECIAL
TAXING AREA WITHIN THE COUNTY WHICH PROVIDES STREET
