MONTGOMERY COUNTY

Chapter 76, title "Animals and Fowl," Montgomery
County Code 1965 (as amended by Ordinance No. 6-20,
Laws of Montgomery County 1967), be and is hereby
repealed and re-enacted, with amendments to read as
follows:

Sec. 76-22. Damages resulting from attacks on
livestock by dogs—Payment of damages from
monies derived from licenses, etc.;
placement of such monies in the general
fund.

All monies arising from the dog licenses or taxes
shall be kept in the general fund by the department of
finance, and shall be used for the payment of damages
for the injury and killing of sheep, poultry or other
livestock.

SECTION 2. Section 76-23, title "Same - Injured
person to apply to justice of the peace," of Article
II, title "Dogs and Cats," of Chapter 76, title
"Animals and Fowl," Montgomery County Code 1965 (as
amended by Ordinance No. 6—20, Laws of Montgomery
County 1967), be and is hereby repealed and
re—enacted, with amendments to read as follows:

Sec. 76—23. Same — Injured person to apply to the

county; appraisement of damages;
report.

When any inhabitant of the county shall have any
sheep, poultry or livestock destroyed or injured by a
dog or dogs, he may apply to the county for the
appropriate damage claim forms. The claimant, upon
receipt of these forms, shall then appoint one
disinterested person as an appraiser, the county shall
also appoint an appraiser, who may be an employee of
the county, and these appraisers, in turn, shall
appoint a third disinterested person as an appraiser,
all to view and appraise the damages sustained by the
claimant, and they, or a majority of then, under oath,
shall state in writing to the county the number of
sheep, poultry or livestock killed, the character and
extent of the injury, if any done, and the amount of
the damages sustained by the owner. Both the
appraisers and the owner of the sheep, poultry or
livestock shall make oath that they believe the same
to have been destroyed or injured by a dog or dogs;
and when the report of such proceedings has been
