MONTGOMERY COUNTY

canvas which is tightly fastened in a manner that will
prevent the loss of any material being transported.
No person shall engage in the business of collecting
or transporting refuse within the confines of
Montgomery County without first obtaining a license
from the Director of the Department of Inspection and
Licenses. Application for such a license shall be
made on or before the first day of May of each year on
forms furnished by the Director and shall contain such
information as he shall prescribe.

SECTION 2. AND BE IT FURTHER ENACTED, That
Subsection (b) (2) of Section 87-14, titled "Collecting
and Transporting — Registration of Vehicles", Chapter
87, titled "Garbage and Refuse" of the Montgomery
County Code 1965, is hereby repealed and re-enacted,
with amendments, to read as follows:

(b)(2) It shall be equipped with a suitable
watertight, leak proof, metal body designed for the
collection of refuse and shall have a suitable tightly
fitting cover of metal or canvas to prevent the
blowing of refuse, which cover shall be in place at
all times, except when loading or unloading.
Provided, however, that an open flat body vehicle
having a suitable tarpaulin or canvas cover, which
shall be in place at all times, except when loading or
unloading, nay be used for transporting refuse firmly
sealed and secured in cardboard boxes or plastic bags.
The body shall be so mounted on the chassis that when
fully loaded, the axle load shall fall within the
Maximum axle load limit prescribed by law. Provided,
however, that after the effective date of this Section
no open body truck or vehicle shall be registered
unless it has been previously registered, and four (4)
years after the effective date of this Section no
registration for an open body truck shall be renewed,
except that an open metal body truck with a tightly
fitting cover of metal or canvas may be used only for
hauling only building materials, trees and parts of
trees, rubble, abandoned vehicles, machinery,
appliances, and nonincinerable materials which cannot
be processed in the County incinerator, and except
that an open flat body vehicle having a suitable
tarpaulin or canvas cover, which shall be in place at
all tines, except when loading or unloading, may be
used for transporting refuse firmly sealed and secured
in cardboard boxes or plastic bags. The body shall
be enclosed steel, packer type, water—tight, leak
proof, readily cleanable and sanitary and so mounted
