COUNTY LOCAL LAWS

Chapter 5
Bill No. 21-71

AN ACT to repeal and re-enact, with amendments,
subsection (a), titled "Application" of Section
87—13, titled "Collecting and transporting —
Collector's license", and subsection (b) (2) of
Section 87-14, titled "Collecting and
transporting — Registration of Vehicles" of
Chapter 87, titled "Garbage and Refuse" of the
Montgomery County Code 1965, to provide that a
licensed collector may transport refuse firmly
sealed in cardboard boxes or plastic bags in a
flat body vehicle covered by a tarpaulin or
canvas and to provide that a special license may
be issued to a licensed collector or hauler for
use of an open body vehicle with tightly fitting
metal or canvas cover for use on special routes
where use of a packer type vehicle is contrary to
law, or a danger to human life or property.

SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
FOR MONTGOMERY COUNTY, MARYLAND, That subsection (a)
titled "Application" of Section 87-13 titled
"Collecting and Transporting - Collectors License",
Chapter 87, titled "Garbage and Refuse", of the
Montgomery County Code 1965, is hereby repealed and
re—enacted, with amendments, to read as follows:

(a) Application. No refuse shall be collected
or transported within the county except by a licensed
collector or hauler; provided, that this shall not
prohibit: a. a person from transporting his own
refuse to an approved place of final disposal provided
that it is transported in a closed body vehicle or
vehicle covered by tarpaulin or canvas tightly
fastened in a manner that will prevent the loss of any
material being transported, b. a licensed collector
or hauler from transporting refuse firmly sealed and
secured in cardboard boxes or plastic bags to an
approved place of final disposal transported in an
open, flat body vehicle covered by a tarpaulin or
