MONTGOMERY COUNTY

OFFERS, OR HOLDS ITSELF OUT AS RENDERING OB SUPPLYING,
PROFESSIONAL ADVICE TO, OR CASE OF, PERSONS WITH
PSYCHIC OR PHYSICAL PROBLEMS RELATING TO DRUGS OR
CONTROLLED DANGEROUS SUBSTANCES, OR WHICH OFFERS
AFTERCARE, AND TRAINING IN THE DIAGNOSIS, TREATMENT,
REHABILITATION AND CONTROL OF DRUG-DEPENDENT PERSONS.

(F) "PERSON" MEANS ANY INDIVIDUAL OR
INDIVIDUALS, PARTNERSHIP, ASSOCIATION OR CORPORATION,
OR ANY FISH, OR ORGANIZATION WHETHER FOR PROFIT OR
NOT, AND ANY COMBINATION THEREOF.

SECTION 8A-3. ADVISORY COMMISSION ON DRUG ABUSE.

(A)    CREATION AMD COMPOSITION; APPOINTMENT OF
MEMBERS; CHAIRMAN. THERE IS HEREBY ESTABLISHED A
COMMISSION ON DRUG ABUSE WHICH SHALL BE ADVISORY TO
THE COUNTY GOVERNMENT. THE COMMISSION SHALL CONSIST
OF THE SUPERINTENDENT OF SCHOOLS OF THE COUNTY, THE
DIRECTORS OF THE DEPARTMENTS OF HEALTH, SOCIAL
SERVICES, AND RECREATION, THE SUPERINTENDENT OF
POLICE, THE STATE'S ATTORNEY, THE PUBLIC DEFENDER, THE
ADMINISTRATIVE JUDGE OF THE CIRCUIT COURT FOR
MONTGOMERY COUNTY, THE ADMINISTRATIVE JUDGE OF THE
DISTRICT COURT HAVING JURISDICTION IN THE COUNTY, ONE
ASSOCIATE JUDGE OF THE DISTRICT COURT ASSIGNED TO
JUVENILE CAUSES FOR THE COUNTY, A MEMBER OF THE
ADVISORY COUNCIL ON DRUG ABUSE FOR THE STATE OF
MARYLAND SELECTED BY SUCH COUNCIL IF IT SO DETERMINES,
A MEMBER OF THE COUNTY COUNCIL, THE COUNTY EXECUTIVE,
AND THE CHAIRMAN OF THE BOARD OF THE CITIZEN'S
COMMUNITY CORPORATION ESTABLISHED UNDER SECTION 8A-4.
THE COMMISSION SHALL ELECT ONE OF ITS MEMBERS AS
CHAIRMAN AND ANOTHER OF ITS MEMBERS AS VICE-CHAIRMAN,
EACH TO SERVE AT THE PLEASURE OF THE COMMISSION, AND
SUCH OTHER OFFICERS AS IT SHALL DETERMINE. THE
COMMISSION MAY IN ITS DISCRETION REQUEST NON-VOTING,
EX-OFFICIO MEMBERS TO ASSIST IN THE PERFORMANCE OF ITS
DUTIES.

(B)    DUTIES. THE COMMISSION SHALL HAVE NO
EXECUTIVE, APPOINTIVE, OR LEGISLATIVE DUTIES. IT
SHALL ADVISE THE COUNTY EXECUTIVE, THE COUNTY COUNCIL,
AND THE DIRECTOR OF THE OFFICE OF DRUG CONTROL IN
CONNECTION WITH THE CONTROL OF DRUG ABUSE WITHIN THE
COUNTY THROUGH LEGISLATIVE, EXECUTIVE, EDUCATIONAL,
AND COMMUNITY ACTION. IT SHALL SPECIFICALLY ADVISE
THE OFFICE OF DRUG CONTROL ON THE RESPONSIBILITIES OF
THAT OFFICE AS SET FORTH IN THIS CHAPTER, INCLUDING
LICENSING RESPONSIBILITY. IT IS AUTHORIZED TO REVIEW
