COUNCIL BILL NO. 25

AN ACT to add new Section 20.311A of Title 20 of the
Howard County Code, Title "Taxation and Public
Credit," subtitle "Water and Sewer Charges and
Assessment" to follow immediately after Section
20.311 [[there]] thereof to establish a
Supplemental In—Aid—of Construction Assessment to
be collected to finance the cost of improvements
to the Savage Sewage Treatment Plant, which
improvements do not qualify for State and Federal
grants, and to provide for the allocation of
sewage treatment capacity and to provide for the
payment by said benefited properties of the
Supplemental In-Aid—of Construction Assessment.

Section 1. BE IT ENACTED BY THE COUNTY COUNCIL
OF HOWARD COUNTY, MARYLAND, that new Section 20.311A
of title 20 be and it is hereby added to the Howard
County Code, Title "Taxation and Public Credit,"
subtitle "Water and Sewer Charges and Assessments," to
follow immediately after Section 20.311 thereof and to
read as follows:

20.311A - SUPPLEMENTAL IN-AID-OF CONSTRUCTION
ASSESSMENT

IN ORDER TO FINANCE THE CONSTRUCTION OF
ADDITIONAL SEWERAGE IMPROVEMENTS AT THE SAVAGE
TREATMENT PLANT (HEREINAFTER REFERRED TO AS
"IMPROVEMENTS") WHICH [[IMPROVEMENTS]] DO NOT
QUALIFY FOR STATE AND FEDERAL GRANTS, THE
DIRECTOR OF PUBLIC WORKS SHALL COLLECT, IN
ADDITION TO ALL OTHER ASSESSMENTS AND CHARGES
PROVIDED FOR IN THIS TITLE, A SUPPLEMENTAL
ASSESSMENT FROM EACH PROPERTY OWNER BENEFITED BY
[[SUCH]] THE IMPROVEMENTS, FOR WHICH STATE AND
FEDERAL GRANT WILL NOT BE RECEIVED. [[SAID]] THE
ASSESSMENT SHALL BE KNOWN AS SUPPLEMENTAL
ASSESSMENT IN-AID-OF CONSTRUCTION AND SHALL BE
COLLECTED AS A SPECIAL ASSESSMENT FROM THOSE
PROPERTIES BENEFITING FROM THE IMPROVEMENTS AS
DETERMINED FROM TIME TO TIME BY THE DIRECTOR OF
PUBLIC WORKS. THOSE PROPERTIES SO BENEFITING
(HEREINAFTER REFERRED TO AS "BENEFITED
PROPERTIES") SHALL BE DETERMINED BY THE DIRECTOR
OF PUBLIC WORKS. IF DEEMED NECESSARY, THE
DIRECTOR OF PUBLIC WORKS MAY ALLOCATE USAGE OF
