(C)  IF, AFTER RECEIPT OF THE SITE RECOMMENDATIONS FROM
THE COMMISSION, THE BOARD IS UNABLE TO AGREE UPON A
SELECTION            FROM            AMONG           THE            COMMISSIONS
RECOMMENDATIONS, THE BOARD SHALL SO ADVISE THE COUNTY
COUNCIL IN WRITING. IN THIS EVENT, THE COUNCIL MAY
REQUEST THAT THE COMMISSION RECONSIDER THE MATTER AND
RESUBMIT RECOMMENDATIONS FOR ACTION BY THE BOARD AND
THE COUNCIL IN THE SAME MANNER AS PROVIDED FOR
ORIGINAL RECOMMENDATIONS.

(D)   FOLLOWING APPROVAL OF A SITE BY THE COUNCIL, THE
BOARD MAY PROCEED WITH ACQUISITION PURSUANT TO THE
PROCEDURE PRESCRIBED BY LAW.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

(House Bill 1479)

AN ACT to repeal and re-enact, with amendments, Section 37(o) of Article 87 of
the Annotated Code of Maryland (1969 Replacement Volume and 1972
Supplement), title "Sheriffs," subtitle "Compensation and Duties," to increase
the salary of the Sheriff of Montgomery County from eighteen thousand dollars
($18,000.00) to twenty-five thousand dollars ($25,000.00) per year; to state that
the number of deputy sheriffs shall be as provided in the annual budget of the
County [[, and]]; to eliminate the provision for designating a chief deputy; and
to provide that all deputies shall be merit system employees.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 37(o) of Article 87 of the Annotated Code of
Maryland (1969 Replacement Volume and 1972 Supplement), title "Sheriffs,"
subtitle "Compensation and Duties," be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

37.

(o) (1) The Sheriff of Montgomery County shall receive an annual salary of
[eighteen] TWENTY-FIVE thousand dollars [($18,000.00)] ($25,000.00) per year
and such allowances for expenses as the County Council of said county shall
provide from its annual budget. The County Council of Montgomery County shall
provide an automobile for the use of the said Sheriff and [his] THE deputies for
the general public work of the office; the said automobile to be operated and
maintained by the said Sheriff and [his] THE deputies at the expense of said
Montgomery County.

(2) The Sheriff of Montgomery County shall appoint [not less than sixteen
deputy sheriffs] THOSE DEPUTIES AS PROVIDED FOR IN THE ANNUAL
BUDGET OF THE COUNTY, who shall provide motor vehicles for their own use
