CHAPTER 186
(House Bill 1434)

AN ACT to authorize the issuance of bonds of the Washington Suburban Sanitary
District in an aggregate principal amount not exceeding [[$4,000,000]]
$5.000.000 for paying the cost of storm water, surface drainage or flood control
projects or systems in the Prince George's County portion of the District,
including the payment of any portion of the costs of sanitary sewer or water
supply facilities resulting from the construction or planned construction of such
storm water, surface drainage or flood control systems, and, for the purpose of
providing an alternate remedy for flood and storm water conditions, taking into
account public interest factors of environmental enhancement, engineering
feasibility and economy of system construction and operation, to pay the cost of
acquiring land, interests in land and structures thereon in flood plains, which
property will then be held, or transferred to other governmental agencies for
public use, with restrictions and limitations against use thereof for habitation,
commercial or industrial activity, and to authorize the issuance of notes in
anticipation of the issuance of such bonds, and to provide for the payment of
such bonds and notes and the interest thereon.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, (a) That, for the purpose of paying the cost of storm water,
surface drainage or flood control projects or systems and carrying out the
provisions of Chapter 526 of the Laws of Maryland of 1943, as amended by
Chapter 917 of the Laws of Maryland of 1945, and Chapter 732 of the Laws of
Maryland of 1947 with respect to storm water and surface drainage systems,
including the cost of any engineering or other surveys of storm water, surface
drainage or flood control needs in that portion of the Washington Suburban
Sanitary District situated in Prince George's County, and for the purpose of
paying for or towards the construction in that portion of the Washington Suburban
Sanitary District of any storm water, surface drainage or flood control project or
system which is the subject of an agreement between the Washington Suburban
Sanitary Commission and another governmental or public authority, commission
or agency pursuant to Chapter 228 of the Laws of Maryland of 1959 or any other
law, the Washington Suburban Sanitary Commission is empowered to issue from
time to time bonds of the Washington Suburban Sanitary District as hereinafter
provided in an aggregate principal amount not exceeding [[four million dollars
($4.000.000)]] five million dollars ($5.000.000). which bonds shall be in addition to
any bonds authorized to be issued under any other law for such purpose. For the
purpose of providing an alternate remedy for storm water and surface drainage
flooding conditions, the Commission may, taking into account public interest
factors of environmental enhancement, engineering feasibility and economy of
system construction and operation, acquire by purchase, condemnation or gift, any
land, interests in land or structures thereon situate which are or may be subject to
the flood conditions sought to be remedied and remove any buildings or structures
thereon, and thereafter hold the acquired property or interests in property with
restrictions against use thereof for any residential, commercial or industrial activity
or with the same limitations and restrictions as to use by lease, sale or other
contractual arrangement deemed satisfactory to the Commission, transfer the use
or title thereof to another governmental agency, board or commission of the State
of Maryland, or Prince George's County, or the federal government, for
governmental, public recreational or other public use not involving habitation,
commercial or industrial activity. The cost of implementing the alternate remedy
by the measures set forth herein shall be deemed to be and it is hereby included
within the cost of storm water, surface drainage or flood control projects or
systems. The cost of such storm water, surface drainage or flood control projects
or systems shall be deemed to include, in addition to all other items of cost, any
