Section 12-1345. Discretion of department in refusing
licenses and permits.
(a) The Director of Inspections and Permits may
refuse to issue an owner's or operator's license to
any applicant who is not of good moral character,
sound mind and good physical health. [[In
determining]] A HEARING SHALL BE SCHEDULED, AND IN HIS
DETERMINATION OF what constitutes good moral
character, the Director [[may]] SHALL consider [[any
of]] the following factors:
(1) Repeated and persistent violations of
the motor vehicle laws which involve moving
violations.
(2) Conviction, or plea of guilty, or plea
of nolo contendere to the violation of any law
involving moral turpitude, including but not limited
to: any sex offense, alcohol or narcotics offense; or
gambling offense.
(3) If applicant is on parole or probation
for a criminal or traffic offense.
(4) If the applicant has, within three (3)
years immediately preceding the date of application,
been released from any penal or correction
institution.
(5) If the applicant is covered by
diplomatic immunity. (6) If the applicant
has had his (her) driver's permit or a
similar permit permanently revoked in any
other jurisdiction.
[[(7) If the applicant is an amputee.]]
(7) If the applicant has had a license to
operate revoked once or suspended twice by any
competent legal authority.
(8) If the applicant has made a false
statement under oath of any material question upon any
form required by the Director; provided that such
person may reapply for a license at the expiration of
six (6) months following the date upon which the form
was filed with the director.
(9) If the applicant is subject to
epilepsy, vertigo, heart ailment, mental illness, or
any other infirmity of the body or mind which might
render the applicant unfit for the safe operation of a
vehicle.
