AN ORDINANCE to repeal and re—enact, with amendments.
Section 2-200 Rule 7 of the Anne Arundel County
Code (1967 Edition and Supplements), Title 2,
"Board of Appeals", Subtitle 2, "Rules of
Practice and Procedure", to provide a maximum fee
for appeals from decisions of the Zoning Hearing
Officer, and to provide for a refund of fees paid
in excess of said maximum.

SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
OF ANNE ARUNDEL COUNTY, MARYLAND, That Section 2-200
Rule 7 of the Anne Arundel County Code (1967 Edition
and Supplements), Title 2, "Board of Appeals",
Subtitle 2, "Rules of Practice and Procedure", be, and
it is hereby repealed and re—enacted, with amendments,
to read as follows:

Section 2-200

Rule 7. Fees. [Fees shall be as follows:]

(A)   NO NOTICE OF APPEAL SHALL BE ACCEPTED BY THE
COUNTY BOARD OF APPEALS UNLESS ACCOMPANIED BY THE FEES
HEREINAFTER SET FORTH:

(1)   [a] Appeals from the decision of the
zoning hearing officer relating to reclassification and
special exceptions.............................. $125.

(2)   [b] Appeals from decisions of the

zoning hearing officer relating to variances... 50.

(3)   [c] Appeals from the decision of

utility extensions............................. 25.

(4)   [d] All other appeals............... 50.

[No notice of appeal shall be accepted by the
county board of appeals unless accompanied by the
required fee.]

(B)   NOTWITHSTANDING THE PROVISIONS OF SUBSECTION
(A) OF THIS SECTION, THE TOTAL OF FEES FOR

CONSOLIDATED, MULTIPLE APPEALS FROM THE ZONING HEARING
OFFICES SHALL NOT EXCEED [[THREE HUNDRED SEVENTY FIVE
DOLLARS ($375.00) SIX HUNDRED DOLLARS ($600.00). NO
FEES PAID AS REQUIRED BY THIS SECTION SHALL BE
RETURNED TO THE APPEALING PARTY.
