AN ACT to add new Sections 41(j). 89(m) and 106(f) to Article 2B of the
Annotated Code of Maryland (1968 Replacement Volume and 1972
Supplement), title "Alcoholic Beverages." subtitle "General Provisions on Issue
of Licenses" and subtitle "Hours and Days for Sale," to follow immediately
after Sections 41(i), 89(l) and 106(e), respectively, I [to provide that in
Worcester County the Board of Liquor License Commissioners shall set the
hours during which establishments serving alcoholic beverages in that county
may remain open on certain days only and to provide an exception as to
Sunday sales on certain days.]] generally amending the laws concerning
alcoholic beverages in Worcester County.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 41(j). 89(m) and 106(f) be and they are hereby
added to Article 2B of the Annotated Code of Maryland (1968 Replacement
Volume and 1972 Supplement), title "Alcoholic Beverages," subtitle "General
Provisions on Issue of Licenses" and subtitle "Hours and Days for Sale," to
follow immediately after Sections 41(i), 89(l) and 106(e), respectively, and to read
as follows:
41.
(J) NOTWITHSTANDING ANY OTHER PROVISION OF THIS
SECTION IN WORCESTER COUNTY, THE HOLDER OF A CLASS B, (ON
SALE-HOTELS AND RESTAURANTS) BEER. WINE AND LIQUOR
LICENSE UNDER THIS ARTICLE BY MAKING APPLICATION IN THE
REGULAR MANNER AND PAYING, THE USUAL FEE MAY_ OBTAIN AN
ADDITIONAL CLASS B, (ON SALE-HOTELS AND RESTAURANTS)
BEER. WINE AND LIQUOR, LICENSE FOR PREMISES USED AND
OCCUPIED AS A BONA_ FIDE RESTAURANT AS MAY BE DEFINED BY
THE RULES AND REGULATIONS OF THE BOARD OF LIQUOR
LICENSE COMMISSIONERS FOR WORCESTER COUNTY, PROVIDED
THAT SAID RESTAURANT HAS A MINIMUM CAPITAL INVESTMENT
OF $150,000.00 FOR RESTAURANT FACILITIES WHICH SUM SHALL
NOT INCLUDE THE COST OF LAND OR BUILDINGS, AND HAS A
MINIMUM SEATING CAPACITY OF 125 PERSONS, NOTHING
CONTAINED HEREIN SHALL PERMIT THE ISSUANCE OF MORE
THAN THREE (3) SUCH LICENSES TO ANY PERSON, OR FOR THE
USE OF ANY PARTNERSHIP, CORPORATION OR UNINCORPORATED
ASSOCIATION IN WORCESTER COUNTY, THE GRANTING OF
ADDITIONAL LICENSES HEREUNDER SHALL BE LIMITED AND
RESTRICTED TO THE PURPOSE OF PROVIDING ALCOHOLIC
BEVERAGES FOR CONSUMPTION ON THE LICENSED PREMISES
ONLY, WITH NO OFF-SALE PRIVILEGES TO BE EXERCISED
THEREWITH.
89.
(M) IN WORCESTER COUNTY, THE BOARD OF LICENSE
COMMISSIONERS SHALL DETERMINE WITHIN THEIR SOLE
DISCRETION THE HOUR AT WHICH ESTABLISHMENTS SERVING
ALCOHOLIC BEVERAGES MUST CEASE SALES ON [[NEW YEAR'S
EVE DAY AND ON NEW YEARS DAY MORNING]] DECEMBER 31
AND JANUARY 1 REGARDLESS OF THE DAY OF THE WEEK ON
WHICH DECEMBER 31 AND JANUARY 1 FALL.
