which subsection of said amendment is found objectionable and that subsection
alone shall be submitted for referendum, the remainder of the amendment going
into effect in accordance with Article 23A, Section 13 of the Annotated Code of
Maryland, 1957, as amended.

NEW CARROLLTON CHARTER AMENDMENT NO. 72-2

AN AMENDMENT TO THE CHARTER OF THE CITY OF NEW
CARROLLTON, PRINCE GEORGE'S COUNTY, MARYLAND, adding the
words "and not contrary to the Constitution and laws of the State of Maryland"
to Section 3. d. of the existing Charter in order to more clearly delineate the scope
of the powers of the Council.

SECTION 3.....

d. Council: Powers and Duties

(1) The Council shall be the legislative body of the City, and shall exercise such
powers and perform such duties as are or may be conferred upon it by the Charter,
the General Assembly, and by the Ordinances of this City, including, but not
limited to, the enactment of all ordinances, resolutions and policies consistent with
the provisions of this Charter AND NOT CONTRARY TO THE
CONSTITUTION AND LAWS OF THE STATE OF MARYLAND. The
members of the Council shall receive such salary or compensation as the Council
shall fix, provided that any increase in salary or compensation voted by the
Council shall not go into effect until approved by the voters at the next general
election. At the first meeting of each new Council, the Council shall elect from
among its members a Chairman and Vice Chairman. The Chairman of the Council
will act as presiding officer during meetings of the Council. The Vice Chairman of
the Council will act in the capacity of Chairman during the Chairman's temporary
absence or disability.
