MOUNT AIRY                                            2319

A Resolution of the Mayor and Council of the Town of Mount Airy to enlarge
the corporate boundaries of the Town of Mount Airy and thereby amend the
Charter of the Town of Mount Airy.

WHEREAS, At a regular meeting of the Mayor and Council of the Town of
Mount Airy held on April 3, 1972, a petition was presented in writing signed by
persons who are owners of certain real estate lying and being contiguous to the
existing corporate boundary lines of the Town of Mount Airy to enlarge the corporate
boundaries of said Town by the annexation of their real property northeast of said
boundaries in the Thirteenth Election District of Carroll County, Maryland; and

WHEREAS, The Mayor and Council of the Town of Mount Airy has caused to
be made a verification of the signatures upon said petition and has ascertained that
the persons signing the petition represent at least twenty-five per cent (25%) of the
persons who reside in the area to be annexed and who are registered voters in
county elections in the precinct or precincts in which the territory to be annexed is
located, and are the owners of at least twenty-five per cent (25%) of the assessed
valuation of the real property located in the area to be annexed; and

WHEREAS, The Mayor and Council of the Town of Mount Airy, pursuant to
the petition requesting annexation, is introducing this resolution providing that the
present corporate boundaries of the Town of Mount Airy be extended to include
the area described in the petition; and

WHEREAS, The Mayor and Council of the Town of Mount Airy will cause a
notice of the proposed enlargement of the corporate boundaries of the Town of
Mount Airy to be published not less than four times at weekly intervals in the
Community Reporter, a newspaper of general circulation in the Town of Mount
Airy and the area to be annexed, said notice describing the proposed enlargement
and circumstances thereto and specifying the time, date and place at which a
public hearing will be held on the proposed annexation, said public hearing is to be
held on June 12, 1972 at 8:00 o'clock P.M. at the Town Hall, Main Street, Mount
Airy, Maryland, the said date being more than fifteen (15) days after the fourth
publication of the notice in the aforementioned newspaper; and

WHEREAS, The Mayor and Council of the Town of Mount Airy deems the
enlargement of the corporate boundaries to be advisable and to be in the public
interest.

SECTION 1. BE IT THEREFORE RESOLVED by the Mayor and Council of
the Town of Mount Airy that all of the land lying within the boundaries of the
hereinafter described parcel shall be annexed to and become a part of the Town of
Mount Airy:

All that parcel of land situate on and adjacent to one of the existing northeast
corporate boundary lines of the Town of Mount Airy between Town Monument
106 and 105 and according to a survey made by J.B. Ferguson Engineering, Inc.,
dated November 17, 1971, is more particularly described as follows:

Beginning at a point in and 67.36 feet from the end of the South 34 degrees 42
minutes 50 seconds West 1258.00 foot line between monuments 107 and 106 of the
corporate boundary of the Town of Mount Airy, Maryland, said point being also
in and 287.20 feet from the beginning of the fourth or South 66 degrees 22 minutes
41 seconds East 795.95 foot line of a conveyance from Irvin Wagner, et al, to W.
Howard Skid more and Matthew W. Witenstein dated March 20, 1972 and recorded
among the Land Records of Carroll County in Liber C.C.C. No. 507, Folio 362,
running thence with said existing corporate line South 34 degrees 42 minutes 50
