2316                                    MUNICIPAL CHARTERS

WHEREAS, At regular meetings of the Mayor and Council of the Town of
Mount Airy held on September 14, 1970 and February 1, 1971, petitions were
presented in writing signed by persons who are owners of certain real estate lying
and being contiguous to the existing corporate boundary lines of the Town of
Mount Airy to enlarge the corporate boundaries of said Town by the annexation of
their real property southeast of said boundaries in the Thirteenth Election District
of Carroll County, Maryland, and on the north and west of said boundaries in
Woodville District of Frederick County, Maryland; and

WHEREAS, The Mayor and Council of the Town of Mount Airy has caused to
be made a verification of the signatures upon said petition and has ascertained that
the persons signing the petition represent at least twenty-five per cent (25%) of the
persons who reside in the area to be annexed and who are registered voters in
county elections in the precinct or precincts in which the territory to be annexed is
located, and are the owners of at least twenty-five (25%) per cent of the assessed
valuation of the real property located in the area to be annexed; and

WHEREAS, The Mayor and Council of the Town of Mount Airy, pursuant to
the petition requesting annexation, is introducing this resolution providing that the
present corporate boundaries of the Town of Mount Airy be extended to include
the areas described in the petition; and

WHEREAS, The Mayor and Council of the Town of Mount Airy will cause a
notice of the proposed enlargement of the corporate boundaries of the Town of
Mount Airy to be published not less than four times at weekly intervals in the
Community Reporter, a newspaper of general circulation in the Town of Mount
Airy and the area to be annexed, said notice describing the proposed enlargement
and circumstances thereto and specifying the time, date and place at which a
public hearing will be held on the proposed annexation, said public hearing is to be
held on August 31, 1971 at 7:30 o'clock P.M. at the Town Hall, Main Street,
Mount Airy, Maryland, the said date being more than fifteen (15) days after the
fourth publication of the notice in the aforementioned newspaper; and

WHEREAS, The Mayor and Council of the Town of Mount Airy deems the
enlargement of the corporate boundaries to be advisable and to be in the public
interest.

SECTION 1. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE TOWN OF MOUNT AIRY, That all of the land lying within the
boundaries of the hereinafter described parcels shall be annexed to and become a
part of the Town of Mount Airy:

a. Brown, Marcy, Linganore, Fire Company, et al, Tract situate on the
southeast sides of the corporate boundaries of the Town of Mount Airy in the
Thirteenth Election District of Carroll County, Maryland, and according to a
survey of Sutcliffe and Associates, dated January 3, 1971 described as follows:

Beginning for the same at a point on the East side of Ridge Avenue, being on
and at a distance of 220.29 feet from the beginning of the 61st line of the
corporate limits of the Town of Mount Airy as found in the Frederick County
Code, Section 21.2, thence for the following 21 new lines of annexation: (1) South
68 degrees 00 minutes 27 seconds East, 968.05 feet to a concrete monument now
set in the ground, (2) South 22 degrees 36 minutes 04 seconds East, 265.94 feet to
a concrete monument now set in the ground, (3) South 10 degrees 38 minutes 17
seconds West, 417.55 feet to a 36 inch oak tree with 6 blazes, (4) South 12 degrees
43 minutes 30 seconds West, 391.05 feet to a concrete monument now set in the
ground near the north side of Maryland Route No. 144, thence running and
binding on said north side of Maryland Route No. 144 the following 8 courses and
