FRUITLAND                                             2249

119. (a) Qualifications. Any citizen of the United States who has attained the
age of eighteen (18) years, and who resides in the Town of Fruitland at the time of
registration, or who is assessed on the tax books of the Town as the owner of real
property of the value of at least $500.00, shall be eligible to register and after
registration shall be eligible to vote at all Town Elections.

(f) Registration. The said Board shall on the third Monday in September and on
the third Monday in March of each year conduct a registration of the qualified
voters of said Town. All registrations subsequent to the first shall be for the
purpose of adding the names of those qualified voters not previously registered and
the removal of the names of those persons who shall have ceased to be qualified
voters. The Fruitland Commission may, not more than once each eight (8) years,
require a re-registration of all the voters of said Town. In addition to the
registrations herein required, the Fruitland Commission may conduct such other
registrations of new voters at such times and places as said Commission may
prescribe by resolution entered in the minutes books of the Commission. Such
additional registrations may be conducted either by the Board of Election
Supervisors or by the Town Clerk of the Town of Fruitland. Whenever the Town
Clerk shall conduct such additional registrations, said Clerk shall possess the same
power and authority as the members of the Board of Election Supervisors to
administer oaths and determine the qualifications and rights of applicants to
register as voters.

(h) Questions. Said Board of Election Supervisors shall determine the
qualifications and rights of each applicant to register by asking such applicant the
following questions, which shall be answered under oath by such applicant:

(1)    Are you a citizen of the United States?

(2)    Have you attained the age of eighteen?

(3)    Are you a resident of the Town of Fruitland,
or are you assessed on the tax books of the
Town as the owner of real property of the
value of at least $500.00?

Should the answer of such applicant be in the affirmative to each such
question, it shall be the duty of said Board to allow such applicant to register. But
should such applicant refuse to answer all such questions, or should the answer of
such applicant be in the negative to any such question, then such applicant shall
not be allowed to register. Should any applicant answer any question falsely, he
shall be guilty of the crime of perjury and subject to the penalties provided by the
law of the State of Maryland. Any applicant who feels that he has been aggrieved
by any ruling of said Board as to his eligibility to register, may appeal to the
Circuit Court for Wicomico County, which Court shall determine such appeal.

(m) Commissioners. Any resident of the Town at least twenty-one (21) years of
age, who is a registered voter of the Town of Fruitland, who shall not have been
convicted of a felony or a misdemeanor involving moral turpitude shall be eligible
for the Office of Commissioner.

SECTION 11. AND BE IT FURTHER RESOLVED, ENACTED AND
ORDAINED BY THE FRUITLAND COMMISSION OF THE TOWN OF
FRUITLAND, MARYLAND, that this Charter Amendment shall take effect
fifty (50) days from the date of passage hereof.
