2232                                    MUNICIPAL CHARTERS

The conditions of said annexation are as follows:

A.  The annexation is to take effect on the 24th day of October, 1972.

B.  Respective properties located in the area to be annexed shall be exempt from
the municipal assessment and taxation until such properties in said area shall have
available and be utilizing substantially all of the municipal and services and
benefits and other services of the City of Frederick; and provided further, that
when a determination is made by the City that substantially all of the municipal
services and benefits are available to properties in said area, written notice thereof
be delivered to the property-owner or owners at least sixty (60) days in advance of
the beginning of the next fiscal year, and that such actions by the City shall
become final and conclusive unless written protest is filed by the property-owner
with the City within twenty (20) days from the date of said notice and the said
property-owner or owners shall have the privilege of hearing relative thereto with
the Mayor and Board of Aldermen of the City of Frederick.

C.   Various individuals or corporations that are presently receiving municipal
services, such as water and sewer, shall pay city taxes based on the Frederick
County assessment beginning with the fiscal year 1973-74 at which time said
properties shall be assessed and placed on the tax rolls of the City of Frederick
and the owner or owners thereof shall at the beginning of the 1973-74 fiscal year
be subject to municipal assessment and taxation on the same basis as the owners of
other property located in the corporate limits of The City of Frederick.

D.  Extension of water, sewer and storm drain lines to the area to be annexed
shall be at the expense of the property-owners in the annexed area and at no cost
to the City; design of all storm drain, water and sewer systems shall be such that
any damage from their installation shall be the responsibility of the property-owner
and not of the City of Frederick.

E.  That the present County zoning classification of B-3 applied to the area to be
annexed shall be retained and shall be converted to the equivalent City
classification of B-3.

AND BE IT FURTHER RESOLVED, ENACTED, AND ORDAINED BY
THE AUTHORITY aforesaid, that the Mayor of The City of Frederick shall call
hearing on the passage of this Resolution, said hearing to be held at 7:30
P.M. on the 7th day of September, 1972 in the Public Meeting Room in the City
Hall Building located on North Market Street in the City of Frederick.
