2224                                    MUNICIPAL CHARTERS

RESOLUTION NO. 2-72

A RESOLUTION to propose an amendment to Article VI, Section 40, entitled
"Eligibility to vote".

SECTION I: BE IT RESOLVED, ENACTED AND ORDAINED by the
Mayor and Board of Aldermen of the City of Frederick, that the Charter of the
City of Frederick, as the same was enacted by the General Assembly of Maryland
in Chapter 539 of the laws of 1951, be amended in Article VI, Section 40, as
follows:

ARTICLE VI. Registrations, Nominations and Elections.
Sec. 40 - Eligibility to vote.

Every person who (a) is a citizen of the United States, (b) is at least
[twenty-one] EIGHTEEN years of age, (c) has resided in the State of Maryland
for at least one year next preceding any city election, (d) has resided within the
corporate limits of the City of Frederick for at least six months next preceding any
city election, (e) has never been convicted of any felony in this state or elsewhere,
or, if he has been convicted of a felony, has been subsequently pardoned for the
offense, and (f) is registered in accordance with the provisions of this Charter, shall
be a qualified voter of the city. Every qualified voter of the city shall be entitled to
vote at any or all city elections, and only qualified voters of the city may vote in
city elections.

SECTION II: BE IT FURTHER RESOLVED, that the date of the passage of
this Resolution is January 20, 1972, and the amendment to the Charter of the City
of Fredrick, hereby enacted, shall become effective on March 16, 1972, unless a
proper petition for a referendum herein shall be filed as provided by Section 13 of
Article 23A of the Annotated Code of Maryland, and provided a complete and
exact copy of this Resolution shall be continuously posted at City Hall, Frederick,
Maryland, until March 16, 1972, and provided further that a fair summary of the
proposed amendment shall be published in the News & Post, a newspaper of
general circulation in the City of Frederick, once in each of the weeks of January
23, 1972, January 30, 1972, February 6, 1972 and February 23, 1972; and that all
sections of the Charter or ordinances or parts of sections of the charter or
ordinances inconsistent with the provisions of this Resolution be and the same are
hereby repealed to the extent of such inconsistency.

SECTION III: BE IT FURTHER RESOLVED AND ORDAINED that the
Mayor of Frederick shall send separately by registered mail to the Secretary of the
State of Maryland and the Department of Legislative Reference the complete text
hereof; the date of referendum election, if any; the number of votes cast for and
against the question containing the Charter amendment, whether in the legislative
body or in a referendum and effective date of the charter amendment.
