RESOLUTION NO. 1-72

A RESOLUTION to propose an amendment to Article VI, Section 58, entitled
"Nominations - By convention" to eliminate Section 58 "Nominations - By
convention".

SECTION I: BE IT RESOLVED, ENACTED AND ORDAINED by the

Mayor and Board of Aldermen of the City of Frederick, that the Charter of the
City of Frederick, as the same was enacted by the General Assembly of Maryland
in Chapter 539 of the laws of 1951, be amended in Article VI, Section 58, as
follows:

ARTICLE VI. Registrations, Nominations and Elections.
[Sec. 58. Same—By convention.

Candidates for elective public office in the City of Frederick may be nominated
by convention held for the purpose of making nominations to elective public office.
A convention shall be defined as an organized assemblage of delegates or voters
representing a political party or principle which at the last regular city election
before the holding of the convention polled at least five per cent of the entire vote
cast in the City of Frederick. A certificate signed by the presiding officer and the
secretary of the convention and showing at least the names, residences, party
affiliations, and offices for which nominated of the persons nominated by the
convention shall be filed with the board of supervisors of elections at least ten days
prior to the time of holding the election at which the candidates for office are to be
voted on.]

SECTION II: BE IT FURTHER RESOLVED, that the date of the passage of
this Resolution is January 20, 1972, and the amendment to the Charter of the City
of Frederick, hereby enacted, shall become effective on March 16, 1972, unless a
proper petition for a referendum herein shall be filed as provided by Section 13 of
Article 23A of the Annotated Code of Maryland, and provided a complete and
exact copy of this Resolution shall be continuously posted at City Hall, Frederick,
Maryland, until March 16, 1972, and provided further that a fair summary of the
proposed amendment shall be published in the News & Post, a newspaper of
general circulation in the City of Frederick, once in each of the weeks of January
23, 1972, January 30, 1972, February 6, 1972 and February 13, 1972; and that all
sections of the Charter or ordinances or parts of sections of the charter or
ordinances inconsistent with the provisions of this Resolution be and the same are
hereby repealed to the extent of such inconsistency.

SECTION III: BE IT FURTHER RESOLVED AND ORDAINED that the
Mayor of Frederick shall send separately by registered mail to the Secretary of the
State of Maryland and the Department of Legislative Reference the complete text
hereof; the date of referendum election, if any; the number of votes cast for and
against the question containing the Charter amendment, whether in the legislative
body or in a referendum and effective date of the charter amendment.
