action or proceeding involving the validity or enforcement of any bond issued
under this [subtitle] SECTION or the security therefor, any such bond reciting in
substance that it has been issued by the mayor and city council in connection with
a public parking [project, as herein defined] FACILITY OR FACILITIES shall
be conclusively deemed to have been issued for such purpose and such project shall
be conclusively deemed to have been planned, located and carried out in
accordance with the provisions of this subtitle.

SECTION 2. AND BE IT FURTHER RESOLVED, That the date of the
passage of this Resolution is December 19,1972, and the amendment of the
Charter of the City of Cumberland, hereby enacted, shall become effective on
February 7, 1973, unless a proper Petition for a Referendum hereon shall be filed
as provided by Section 13 of Article 23A of the Annotated Code of Maryland. A
complete and exact copy of this Resolution shall be continuously posted on the
North Centre Street entrance of the City Hall, Cumberland, Maryland, until
January 28, 1973, and the title of this Resolution shall be published in a newspaper
of general circulation in the City of Cumberland not less than four (4) times, as
weekly intervals, before the aforesaid date.

SECTION 3. AND BE IT FURTHER RESOLVED, That the Mayor of the
City of Cumberland is hereby specifically directed to carry out the provisions of
Section 2 hereof regarding the giving of notice by posting and publication of this
Resolution approving the same, and, as evidence of said compliance, the City
Clerk shall cause to be affixed to the Charter Amendment Resolution a certificate
of the publication of the newspaper in which the summary of this Resolution shall
have been published, and the Mayor, if there is no Petition for a Referendum, shall
declare the Charter Amendment to be effective on the effective date herein
provided for, which is February 7, 1973, by affixing his signature hereto in the
space provided below the effective date hereof.

SECTION 4. AND BE IT FURTHER RESOLVED, That, if a proper
Petition for a Referendum on the Charter Amendment herein proposed is filed, the
Mayor and other proper officials of the City of Cumberland shall comply with all
the provisions set forth in Sections 13 to 17, inclusive, of Article 23A of the
Annotated Code of Maryland.

SECTION 5. AND BE IT FURTHER RESOLVED, That as soon as the
Charter Amendment hereby made shall become effective, either as herein provided
or following a Referendum, the Mayor shall cause the same to be registered with
the Secretary of the State of Maryland, and with the Department of Legislative
Reference of Maryland, and shall cause to be certified the effective date thereof,
the number of Councilmen voting for and against the Resolution, and, if a
Referendum is held, the date thereof and a report on the votes cast for or against
the proposed amendment.

This Resolution passed this 19th day of December, 1972.
