1984 EXECUTIVE ORDERS
WHEREAS, That Executive Order requires each Commission to recommend a
specified minimum number of persons with respect to each judicial vacancy
existing in a trial court within the jurisdiction of the Commission; and
WHEREAS, By Virtue of the creation of the District Court of Maryland, there
will exist a large number of initial judicial vacancies in some areas of the State,
and thus adherence to the prescribed minimum number of recommendations for
each such vacancy would be unrealistic and detrimental to the concept of
recommending only the names of those best fitted for judicial office;
NOW, THEREFORE. I, Marvin Mandel, Governor of Maryland, hereby
promulgate the following order effective immediately:
The Executive Order dated July 17, 1970, establishing the Governor's
Commissions on Trial Court Judicial Selection for the eight judicial circuits of the
State, is hereby amended by adding the following paragraph to the Order,
immediately prior to the last paragraph on page 5 of the Order:
"NOTWITHSTANDING THE ABOVE PROVISIONS, WHERE IN ANY
JURISDICTION, THERE SHALL EXIST SIX OR MORE BUT LESS
THAN NINE JUDICIAL VACANCIES AT THE SAME TIME, THE
APPROPRIATE COMMISSION SHALL RECOMMEND FOR
APPOINTMENT NOT LESS THAN THREE PERSONS FOR EACH
VACANCY. WHERE IN ANY JURISDICTION THERE SHALL EXIST
NINE OR MORE VACANCIES AT THE SAME TIME, THE
APPROPRIATE COMMISSION SHALL RECOMMEND FOR
APPOINTMENT NOT LESS THAN TWO PERSONS FOR EACH
VACANCY."
