1804                                     LAWS OF MARYLAND                                 Ch. 891

CARRIER OR CONTRACT CARRIER MAY PLACE ANY ADDITIVES IN
ANY GASOLINE OR SPECIAL FUELS. THIS SUBSECTION SHALL NOT
PRECLUDE ADULTERATION OR CO-MINGLING OF GASOLINE WITH
OTHER PETROLEUM PRODUCTS WHICH OCCURS AS A NATURAL
CAUSE OF TRANSIT AND AS A CONSEQUENCE OF TRANSIT IN
PIPELINE CARRIERS.

(I) ANY RETAIL SERVICE STATION DEALER, WHO WITH THE
INTENT TO DEFRAUD COMINGLES GASOLINE BY BRANDS OR
GRADES IS SUBJECT TO THE PROVISIONS OF SECTION 157(G).

[[(1)]] (J) THE COMPTROLLER OF THE TREASURY, WITH THE
APPROVAL OF THE BOARD OF PUBLIC WORKS, FOR THE FISCAL
YEAR 1974 MAY EXPEND AMOUNTS HE DEEMS NECESSARY AND
EXPEDIENT FOR THE PROPER ADMINISTRATION AND
ENFORCEMENT OF THIS SUBTITLE. THIS AUTHORITY INCLUDES
BUT IN NO WAY IS LIMITED TO THE EMPLOYMENT OF EMPLOYEES
HE DEEMS NECESSARY. ALL EMPLOYEES SHALL BE EMPLOYED IN
ACCORDANCE WITH THE PROVISIONS OF ARTICLE 64A KNOWN AS
THE MERIT SYSTEM LAW, BUT NOTHING THEREIN PRECLUDES
THE COMPTROLLER FROM APPLYING TO THE BOARD OF PUBLIC
WORKS FOR AUTHORITY TO EMPLOY PERSONNEL ON EITHER A
CONTRACTUAL OR TEMPORARY BASIS.

(K) IN THE EVENT THAT THE CERTIFICATION OR REGISTRATION
OF ANY RETAIL SERVICE STATION DEALER IS SUSPENDED OR
REVOKED UNDER THE PROVISIONS OF THIS SUB-SECTION
WITHOUT FAULT ON THE PART OF THE RETAIL SERVICE STATION
DEALER, THE SUPPLIER OF THE UNAPPROVED PRODUCT SHALL BE
LIABLE IN DAMAGES TO THE RETAIL SERVICE STATION DEALER
SO SUSPENDED OR REVOKED IN AN AMOUNT EQUAL TO THE NET
OPERATING LOSS SUSTAINED DURING THE PERIOD OF THE
SUSPENSION OR REVOCATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 891

(Senate Bill 1000)

AN ACT to add new subsection (AA) to Section 5 of Article 25A of the
Annotated Code of Maryland (1966 Replacement Volume and 1971
Supplement), title "Chartered Counties of Maryland," subtitle "Express
Powers," to follow immediately after subsection (Z) thereof, authorizing the
creation of a commission empowered to establish compensation and allowances
for members of county councils in charter counties.

SECTION I. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new subsection (AA) be and it is hereby added to Section 5
of Article 25A of the Annotated Code of Maryland, (1966 Replacement Volume
and 1971 Supplement), title "Chartered Counties of Maryland," subtitle "Express
Powers," to follow immediately after subsection (Z) thereof, and to read as
follows:

(AA)         TO ESTABLISH BY ORDINANCE A COMMISSION

EMPOWERED TO SET COMPENSATION AND ALLOWANCES TO BE
PAID TO MEMBERS OF COUNTY COUNCILS. WHEN ESTABLISHED,
THE COMMISSION SHALL SET THE COMPENSATION AND
ALLOWANCES WITHIN 15 DAYS AFTER THE BEGINNING OF THE
FOURTH YEAR OF THE TERM OF EACH COUNCIL. THE
