SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

AN ACT to repeal and re-enact, with amendments, Section 70-16 of the
Montgomery County Code (1965 Edition, as amended) and Section 59-12 of the
Prince George's County Code (1963 Edition, as amended), being also Articles
16 and 17 of the Public Local Laws of Maryland titled "Montgomery County"
and "Prince George's County," respectively, subtitled "The Maryland-National
Capital Park and Planning Commission," to allow for members of the Merit
Board to continue to serve beyond their term until a successor is duly
appointed, and to provide for four-year terms of members effective July 1, 1973.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 70-16 of the Montgomery County Code (1965
Edition, as amended) and Section 59-12 of the Prince George's County Code (1963
Edition, as amended) being also Articles 16 and 17 of the Public Local Laws of
Maryland titled "Montgomery County" and Prince George's County,"
respectively, subtitled "The Maryland-National Capital Park and Planning
Commission," be and it is hereby repealed and re-enacted, with amendments, to
read as follows:

(b) For the purpose of making and adopting the rules and regulations necessary
to carry out the provisions of this section, there is created the Merit System Board
of The Maryland-National Capital Park and Planning Commission. The Board
shall consist of three members to be appointed by the Commission all of whom
shall be residents of the Maryland-Washington Regional District and no more than
two members from any one county[.], EXCEPT THAT NOTHING
CONTAINED HEREIN SHALL BE DEEMED TO REQUIRE THAT
APPOINTMENTS BE MADE FOR THE PURPOSE OF ROTATING
MAJORITY MEMBERSHIP ON THE BOARD BETWEEN RESIDENTS OF
THOSE PORTIONS OF MONTGOMERY COUNTY AND PRINCE
GEORGE'S COUNTY LYING WITHIN THE DISTRICT. [The three
members] MEMBERS of the Board [shall be appointed as of July 1, 1969. Of the
persons first appointed, one shall have a term of one year, one shall have a term of
two years, one shall have a term of three years, all dating from July 1,1969. As of
July 1, 1970; July 1, 1971 and July 1, 1972, and each three years thereafter a
person shall be appointed for a term of three years.] APPOINTED PRIOR TO
JULY 1, 1973, SHALL CONTINUE TO SERVE THE UNEXPIRED
PORTION OF THEIR THREE YEAR TERMS. EFFECTIVE JULY 1, 1973,
MEMBERS OF THE BOARD SHALL BE APPOINTED FOR A TERM OF
FOUR YEARS. Vacancies of the Board shall be filled in the same manner as for
the making of original appointments. One member of the Board shall be named by
the Commission as Chairman and shall serve as Chairman at the pleasure of the
Commission. [If by August 1, 1969, or in any year thereafter the appointments of
any of the members required herein have not been made as provided herein, on or
after August 1, the Governor of Maryland shall appoint one or more persons to
