and "Restrictions Upon Licensees," to [ [entitle bona fide yacht clubs meeting
certain requirements in all of Anne Arundel County to apply for an alcoholic
beverage license]] to eliminate a yacht club alcoholic beverage license in Anne
Arundel County, and generally relating to a yacht club license in Anne Arundel
County, and clarifying the numbering system.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 28(g) and 121(a) of Article 2B of the Annotated
Code of Maryland (1968 Replacement Volume), title "Alcoholic Beverages,"
subtitles, respectively, "Local Licenses and License Provisions," and "Restrictions
Upon Licensees," be and they are hereby repealed and re-enacted, with
amendments, to read as follows:

28.

[[(g) In [the eighth election district of Anne Arundel County, 1 ANNE
ARUNDEL COUNTY the owner or owners of any bona fide yacht club which
has slip and/or dockside capacity for not less than twenty-five yachts, which has a
bona fide membership of not less than fifty persons, and which has not less than
five acres of land immediately adjacent thereto, whether an individual, association
or corporation, shall, without further residential, voting or locative qualifications,
be entitled to procure a license for the sale of any and all alcoholic beverages
within the confines of its said property limits. The cost for such license shall be
$1,000.00 each calender year and shall permit the sale of such alcoholic beverages
on each and every day and shall permit the playing of music and dancing, and
nothing contained in subsection (a) of this section, relating to special Sunday
licenses shall apply to any licenses issued pursuant to this subsection. Such licenses
and the licenses thereunder shall be subject to all laws, rules and regulations
applicable in Anne Arundel County to the sale of alcoholic beverages, not
inconsistent with the provisions of this subsection.]]

[[(h)]] (G) (1) For a period of two years from April 30, 1961, the number of
premises for which licenses for the sale of alcoholic beverages at retail may be
issued in the fourth precinct of the fifth election districts of Anne Arundel County
shall be limited to the number of licensed premises in existence in the district in
which the premises are located on April 30, 1961; provided, however, that the
board of license commissioners of Anne Arundel County are hereby authorized to
limit the number of licenses, other than those licenses specified in subsection
[[(h)]] (G) (2) of this section, issued in any precinct of any district of Anne
Arundel County for a period of one year.

(2) Nothing in this subsection shall apply to the issuance of the following types
or classes of licenses.

(a) Any Class C licenses as set forth in §§15 and 20 of this article.

(b) Beer, and beer and wine. Class C, 7 days licenses as set forth in
subsection (b) of §25 of this article.

(c)  Beer, wine and liquor, Class C, 7 days licenses as set forth in subsection
(c) of §25 of this article,

(d)  Race track licenses, as set forth in subsection (b) of §28 of this article.

(e) Beach and amusement park licenses, on sale generally, as set forth in
subsection (f) of §28 of this article.
