CHAPTER 851
(House Bill 1201)

AN ACT to add new Sections 419 and 420 to the Code of Public Local Laws of
Queen Anne's County (being Article 18 of the Code of Public Local Laws of
Maryland), title "Queen Anne's County," to follow immediately after Section
418 thereof, as added by Chapter 583 of the Acts of 1966, to be under the new
subtitle "Public Works," in Queen Anne's County to create and generally relate
to the position of Director of Public Works and to the Queen Anne's County
Department of Public Works.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 419 and 420 be and they are hereby added to
the Code of Public Local Laws of Queen Anne's County (being Article 18 of the
Code of Public Local Laws of Maryland), title "Queen Anne's County," to follow
immediately after Section 418 thereof, as added by Chapter 583 of the Acts of
1966, to be under the new subtitle "Public Works," and to read as follows:

PUBLIC WORKS

419.

(A)     THE DIRECTOR OF PUBLIC WORKS SHALL BE AN
ENGINEERING GRADUATE OF A COLLEGE OR UNIVERSITY OF
RECOGNIZED STANDING [[; ]] AND A REGISTERED PROFESSIONAL
ENGINEER, OR A PERSON WHO HAS HAD 5 YEARS' EXPERIENCE IN
ENGINEERING. HE SHALL HAVE SUCH OTHER QUALIFICATIONS AS
MAY BE PRESCRIBED BY LAW OR REGULATION. HE SHALL BE
APPOINTED SOLELY WITH REGARD TO HIS QUALIFICATIONS.

(B)   THE DIRECTOR SHALL BE APPOINTED BY, AND SHALL BE
RESPONSIBLE TO, THE COUNTY COMMISSIONERS, WHO SHALL
DETERMINE HIS SALARY. HE SHALL, SUBJECT TO THE APPROVAL
OF THE BOARD OF COUNTY COMMISSIONERS OF QUEEN ANNE'S
COUNTY OR THE QUEEN ANNE'S COUNTY MERIT BOARD, FIX THE
COMPENSATION OF A SECRETARY-TREASURER AND SUCH
ENGINEERING, LEGAL, CLERICAL AND OTHER PERSONNEL AND
HELP, AS FROM TIME TO TIME HE MAY DEEM NECESSARY TO
CARRY OUT THE PROVISIONS OF THIS CHAPTER. THE
SECRETARY-TREASURER APPOINTED BY THE DIRECTOR SHALL
RECEIVE AND ACCOUNT FOR ALL MONEY WHICH SHALL BE DUE
AND PAYABLE TO THE DEPARTMENT FROM ANY SOURCE
WHATSOEVER.

(C)    ALL MONEYS DEPOSITED SHALL BE PROTECTED BY A
DEPOSITORY BOND, OR BY SUCH OTHER SECURITIES AS MAY BE
APPROVED BY THE DEPARTMENT. THE SECRETARY-TREASURER
SHALL GIVE BOND TO THE STATE OF MARYLAND FOR NOT LESS
THAN $25,000 WITH A GOOD AND SUFFICIENT SURETY TO BE
APPROVED BY THE COMMISSIONERS, WITH THE CONDITION
"THAT IF THE ABOVE BOUNDEN ... SHALL WELL AND FAITHFULLY
EXECUTE HIS OFFICE AND SHALL ACCOUNT TO THE DEPARTMENT
FOR ALL MONEYS WHICH HE SHALL RECEIVE FOR ACCOUNT OF
THE DEPARTMENT, OR BE ANSWERABLE FOR BY LAW, THEN THE
SAID OBLIGATION TO BE VOID, OTHERWISE TO BE AND REMAIN IN
FULL FORCE AND EFFECT." THE BOND, WHEN APPROVED, SHALL
